green_world, it's in Los Angeles, CA. They will provide you the Temp DL. They will tell you that they need check with the Immigration office.

Another key Republican calls for H-1B cap hike - Computerworld (http://www.computerworld.com/s/article/9215970/Another_key_Republican_calls_for_H_1B_cap_hike)
I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.
Lawmakers will listen to folks who participate in lobby/advocacy activities..apparently H-1B lobby/advocacy is louder than the GC backlog lobby/advocacy and that's what we hear in the news.

Please tell your immigration attorney that you will not give him 6 thousand dollar fees but only give $10 because you love money
Please tell the restaurant you go to for lunches and dinner that you will not pay as per their bill of $50 for 2 people but will only pay $10 as you love your money
Please tell your wife that both of you will not eat for 5 days and save $100, because you love your money
If people do not value IV then IV is not the place for them. IV allowed everyone to file I485 in July and get EADs . You are able to get your EAD freedom because of IV and that is priceless.
You gave perfect examples here. Let's take a close look.
If you think the atterney fee worth $10, you wouln't hire an atterney asking for $6k. Samething with the restraunt check. Samething with IV contribution. If you think $100 is too high, you don't pay it. But if you think it worth $10 you simply ask for it, like everybody will do. Imagine a car saleman responds to his potential buyer's request to a lower price of a car with insulting remarks, he'll loose this customer and many more.
And IV ALLOWED everyone ...? You went too far, pal.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

Just saw that this dude is banned. Its good. He created a fake profile recently to divide us.
Strange, this guy gets banned, but the person that opened a thread seeking advise on his "shop-lifting" immigration advice, does not. Wonder what our standards are with regards to banning people.
[Dont want to report posts any longer either as those seem to be falling on deaf ears..]

Was there a bill to create this category or this was decision taken by the USCIS.
Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)
Whcih categories do Political Asylees or Refugees get into?
I think that is an Open category and anyone who can show that their life is in danger in their Homeland can apply...For Iraq, since tehre are too many, they may be limiting 5K per year...

Let me guess, you are a pakistani terrorist. Now you are jealous that how come an Indian muslim win 2 oscars? How will you give out your hateful message to other pakistanis terrorists that indian muslims are being torchured, so you have to "save" indian muslims. Too bad, no pakistani got an oscar. I know why, because the terror capital of the world is going down the drain pretty fast.
.
Sanju, these comments were uncalled for. I understand your emotions on ARR winning Oscars but just don't bash someone who has different views. The guy never said anything about ARR, he just said his work in Dil Se was better and many people may agree with him. Why would you call him a terrorist??? Come on man and you say you want GC because you got exceptional skills ....you mean exceptional non-sense hatred........ on a lighter note ARR can apply GC in EB1 category and get it quickly :p

It is important to note that for this particular sample size of 246 cases, the percentages listed above represent statistically valid figures based on generally accepted statistical reporting guidelines.
without the number of student intake doubling/trembling up to make it one
The number of foreign students has definitely increased since then. The quota is not that
big, so even a small increase like say 10% in the number of foreign students is enough to
swamp the quota.
http://www.usatoday.com/news/education/2008-11-16-foreign-students_N.htm
These numbers are truly historic," says Goli Ameri, assistant secretary of State for educational and cultural affairs. "We haven't just covered lost ground we have now surpassed" previous records.
Plus more than enrollment, it is the economy that governs how soon the quota is reached. In my experience, the economy
showed good growth after 2005, which understandably led to increased hiring.

The employers will still be paying only the official prevailing wage, which is far
below the real market wage, and it will be business as usual. Again, this is the
loopholes at work, in this case in the legal definition of prevailing wage. Most
employers who are using H-1Bs as cheap labor are doing so FULLY LEGALLY.
The true rate of abuse of the H-1B program is near 100%.
THE FRAUD ISSUE IS IRRELEVANT

By March 2007, and using that same calculation, USCIS had a backlog of 1,275,795. (page 11)
In last year’s annual report (at pp. 6-11), the Ombudsman analyzed USCIS’ redefinition of its backlog. That analysis is not repeated here, as the backlog redefinition is unchanged. The current definition continues to consider “backlogged” only the cases pending after subtracting those cases not yet ripe for adjudication, “where even if the application or petition were approved today, a benefit could not be conferred for months or years to come.
[Unripe cases are] excluded from the number of cases in the backlog but remain in the pending.”
Pending Cases Not Included in "Backlog" is 1,316,740 (Fig 1, 2nd column, page 14)
Total Pending = Backlogged + Unripe = 1,275,795 (page 11) + 1,316,740 (Figure 1, page 14) = 2,592,535 (as of March 2007)
So as per USCIS a total of 600,000 applications were pending until June. We can add another 600,000 for july-aug... total now 1.2 Million
Firstly, it is not possible that pending = backlogged + unripe = 600K because there were 2.5M+ pending cases (as explained above) in March 2007. Thus, 600K should be pending EB cases or total backlogged cases.
Secondly, it is unlikely (although possible) that there are 600K pending EB cases because this means that there are 2M family cases.
Thirdly, it is not possible to have 600K total backlogged (= EB + Family + ...) as explained in previous post. Thus, assume 400K (out of 1.3M+) unripe EB cases also. So EB total becomes 1.6M.
Fourthly, consider cases stuck in labor after Aug 17 2007.

FBI Namecheck status (not good news) (pg. 37 of the report)
As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year over a 44 percent increase in the number of cases pending more than 33 months.4

HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help attract and retain high-skilled workers. But in the poll, 56% of Republicans earning more than $75,000 annually would strongly or partially agree with candidate who would bar illegal immigrants from path to citizenship
What is the intent in relating high skilled legal immigrants and illegal immigrants, with the usage of the word But in the next sentence? It is gross disinformation and tries to blend together two disparate immigration issues. I would think the WSJ would know better, considering that English is the first language of its writers and editors.
Just for the record: High skilled legal immigrants are here LEGALLY and have jumped through all the hoops thrown at them by the system, but are yet to find a solution to their misery due to a system which refuses to revisit its antediluvian rules."

I don't think there is any way of knowing if your case is pre-adjudicated. The only way you will come to know is if you receive an RFE or an interview appointment.
Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated. I don't understand why most of the people are ignoring this simple fact. I think we need to stop consider USCIS a mystery box, and start treating it like an organization that processes the applications in a structured way.
I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.
