Lets see, she
1. was here illegally
2. was convicted of shoplifting.
3. Drove without a license.
4. Had unpaid driving fines. (Bet she didnt have driving insurance either).
She had her delivery in a hospital which automatically assures adequate care for the child (paid for by the good citizens of Maricopa county, i should add).
As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications.
Yes it would have been humiliating, but whose fault is that?
Articles like this are published primarily to sway public opinion in favor of illegal aliens and amnesty. Judging by the responses I am impressed who effective they are.
From your above Post - "As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications."
No suprise if 12/21/2012 happens real, people like you among us, I think Mayans must have predicted people like you in this era.

That is cool. By the way, do you have to pay lagaan to US govt, I mean taxes on your kheti-baadi?
I am already paying tax on my mortgage, I dont want to pay extra taxes for growing vegetables in my own backyard.

I like the idea. We had enough talk (positive and negative). Let us start working on it.
How do we start? Where to start?
Got an update from realizeit. He/she initiated contact with IV Core. We are waiting for a response after which we can form a plan of action. Please stay tuned.

A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.

Why so much emphasis on growing your own vegetables?
What crop should I grow?
EB3 Guys,
Take it easy... This is just for humour, to have fun at these times.
No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India, own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Retire by the time your kids become earners. Grow vegetables in back yard. Do gardening and have fun. Thats how life should be. Do not hope for green card. H A V E F U N.

first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?
Hello Pascal
I tend to agree with every word you said, it is not EB2 or EB3, in general it is EB community as a whole. Recapture+STEM+removal of country limit, will help us all a lot. Lets just focus on this chore. And not get swayed away with winning and complaining.
Take care

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?
No matter what whether your case is complicated or not, it is always better to go with an attorney. My brother did that back in 2002 to represent him, but for the attorney his case would have been rejected even though his case was pretty straight forward.
His attorney rightfully explained the IO about his case which had been tranferred from CSC to NSC and finally his and his wife's case approved on the interview day.

This is an very very good forum that has helped to answer many of my questions, or clear myths if I might say so... Thanks to everyone who have been posting.
I had one question which I hope someone could help me with. I have a full-time job offer in a very reputed company and am in the same boat as many before me with graduation towards May end (cannot get a degree completion letter before that) and no hopes of the quota for 2009 (Master's) lasting till then. My employer can also apply for the H1 based on my undergrad because my job profile is such. I wanted to know what are the pros and cons (specifically cons) of doing so for the future legal paper-work. I know for one that I might get into the lottery scenario if the similar situation like last year happens. However, I cannot avoid that. I specifically wanted to know what could happen if I do have to change jobs in the next 3 years (and the new employer has specifically hired me based on my Master's degree). In addition, if I have the company start my GC paperwork after 1 year and I need to renew my H1 after 3 years based on my Master's degree, would I need to restart the GC process?
Any other disadvantages of applying for the undergrad quota (for a Master's student) would be welcome.
Thanks.

Here is another story. My spouse has been working for the same firm for 7 years now. After finishing her Cost Accountancy in India, she received MS in Accounting and MBA in systems management from a top B-School in the US. Even then, her case was filed under EB-3, after a two-year wait because her company does not immediately process GC for newcomers. Her case went to the Dallas BEC for LC clearance in 2003. After that we havent heard a peep from the Dallas BEC. Her lawyers, one of the top law firms in the county, are not helpful at all. They wouldnt tell us our case number so that we can check the status ourselves or tell us what they are doing to pursue the case. Apparently, the company has been burnt by employees who have left the day after getting their GC. Hence, the Law firms motto is mum and the HR department in the company is not doing very much to assist. Besides assuming that miraculously the LC is approved, the EB-3 for India is so badly retrogressedwell, we feel hopeless. Moreover her company has a bond agreement, if anyone leaves before completing 2 years of full-time service after receiving the GC they have to pay a fine of 10 grand. Her job involves extensive travel, which is really putting a strain on our family. However, we are in no position to change jobs, even within the same firm. I can apply, but then, it is another 6 grand for processing and I will be way back on the line, and the standards for EB-1 is so exacting and the paperwork required is so daunting that it will take months to get all the paperwork and letters together. And, my school is not very enthusiastic about sponsoring people under EB-2. Anyway, whats the point of filing under EB-2 now?
