I totally understand the emotional point of someone being want to be a Indian Citizen but I have to stress there is no other country in the world like U.S.A. This is the country where every human being is treated with utmost respect (don't try to show me exceptions - U.S. is a country where most of things are close to being perfect imaginatively), have freedom to say anything they want without getting intimidated and U.S is a country I believe will be the last bastion for humanity when terrosists/fundamentalists spread their tentancles and take over the world by force or other means (if not now probabbly in the next 100-150 years). Hypocrisy is relatively less. We Indians live in a dream world nurtured by the Indian politicians, who try to inject doses of patriotic non-sense into the masses while they themselves stove away million of dollars in Swiss banks. 70% of Indian population lives below poverty line and the educated masses of India think that their country will become a super power by 2020. Politicians like Mayawati play caste politics and dream of taking the top most post while our liberal media, without a wee-bit of shame, extends its highest support for them. Corruption is part of our daily life and we are part of the everyday corruption but we still find no fault in our society. Our population growth is beyond control while not a single politician is concerned about the stress it is going to create on our natural resources in the future. Our education system is in shambles but our great politicians fight for increasing the reservation system to different castes just for the sake of garnering more votes. And the list goes on. Alas���God help India.
FYI: I am a Indian and haven't even started my greencard process, for the same emotional reasons you mentioned, intending to R2I soon. Given a choice and circumstances, I would have opted for U.S.C as "I have no hope for this world neither do I wish for it" - quoting Bhagawan Krishna from Bhagavad Gita.

I don't know why but we tend to be satisfied with lsmall benefits...

But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.

This is an excellent question and I was also looking for an answer. I am into my 6th year of H1-B(exactly 5 years 1 month) and also have an approved EAD & AP.
I have a great JOB offer but hesitating to invoke AC21(moving using H1-B/EAD) because these days there are many 485 DENIALS( the moment I1-40 is REVOKED). And NOTHING is guaranteed even if we send the AC21 documents to USCIS. And the EAD automatically gets invalid anyways when the 485 is denied.
Doing some research to find out if H1-B extension beyond 6th year is valid if 485 - gets DENIED? (Example: If I get a 3 year H1-B extension based on my current I-140 approval)?
Also not sure if it applies in my case as I still have 10-11 months of H1-B remaining and if I decide to take up this oppurtunity in the next couple of months and 485 gets DENIED after that. Good news but sounds too good too be true. On an average a family takes away 2.5 visas and going by this only 50,000 applications for primary bene is pending.
So if they are giving this info to Senator for free why are they asking us to pay $5K for this; unless we requested different information.

Generally there are lots of people getting affected. But there is no one to lead the fight. I am sure once we start people will come and join. I am in the process of contacting the attorneys and consulting companies to fight together. I am also hoping for IV core to come forward and give us direction on this. I am ready to lead and fight. Just in, Obama Administration wants to change law allowing employee to sue past employers and seek compensation. Current laws allows employee to sue for events up to 24 months in the past. This will change and suing employer is going to be a lot more easier. Bring it on baby, this time employees will be millionaires by suing body-shoppers. I am no longer going waste my money to buy lottery ticket :p

Honestly, I agree with you...but the underlying fact is some people get motivated for calling the senators and some for anonymous fax/email/flowers and some for rallies. There is definitely a subset who does all...but unless you are a Gandhi/MLK/JFK/Mandela....it's hard to drive people in one route.

we do all of the above and more. if you like something more than the other that's perfectly fine and dandy. but if we can't collect a critical mass for an action, we lose effectiveness and shoot ourselves in the foot.
in a group this large you simply have to help the commom action and agenda for success. each opinion is important but at the end of the day the common action must be done by all, as far as possible.

Did it occur to anyone that we are only talking about compensating Aman the $64k he spent already. Imagine if he had made use of that $64k as an investment(let us say a safe investment with minimum returns) of that amount it should have exceeded that $64k value by now.
The least we can do at this moment is to immediately refund Aman and other core team members the amount they have spent towards the administrative costs of IV. Pappu / Logic Life / Other core team members, please let us know what kind of legal/administrative action is required to get this done.
We will immediately start a funding drive towards filling in this shortage from the total IV funds. IMHO on the longer run the smaller funds ($10, $20 etc) should not be neglected.
Let us figure out the required amount and have a new thread started about this. This settlement should be treated with high priority before any other funding drive. Pledging my $200 towards this.

Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. The kind of work and effort that is needed to push a single provision is phenomenal and needs lot of capital. The more the better. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. This website is simply a tool for us to communicate to everyone. The big effort is the lobbying work. Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
Also exluding STEM grads from quota.

I hope you are not joking here, did you try to port your EB-3 date to some old PD or change from EB-3 to EB-2?
I am surprised how come PD is not current and USCIS denies I-131 based on the grounds that I-485 approved.
Something is definitely wrong here, unless its USCIS system glitch which considers the preadjudicated (pre-approved) cases as approved and then deby subsequent benefits associated with AoS (I-485) pending application.

Here are my observations.. Correct me if I am wrong..
1. L1 option for IT is essentially killed
2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.
3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.
4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.
5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.
6. Need more clarity on where H1B outsourcing will be stopped...
Good recap. This bill is not about liberating employees. This bill is to kill H1Bs and L1s irrespective of whether the company is a consulting company or a direct employer.
Net result ? more outsourcing. Big outsourcing firms have enough experienced employees on their payroll to do outsourcing effectively.
If this bill passes, it will be a shameful day for USA.
