I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

I would also check if your original GC sponsoring employer (Company A) is not involved in any fraud investigations by USCIS. In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. Send an email to info at immigrationvoice dot com so IV can get in touch with you to help.

Yes, I agree - my experience has been the same. The customer service representative insisted the receive date was whatever showed up in the online status, even though it was ~45 days after the receipt date printed on my receipt notice.
Btw, I have a question about background/namecheck. I remember reading someplace (official) that fingerprints are valid for a period of 15 months. Now imagine this - at the end of that period, you are fingerprinted again, and while the background/namecheck is in progress the "annual lottery" period opens up in Jul/Aug/Sept. Is that file skipped again since background check is pending?

I filed I-40 on June,1th 2007. My lawyer will file my I-485 & I-765 by July 1st. I'm currently on F1- status , When i can start working? do i get an authorization to work before approval of the I-40?

AC21 can be as safe as a any normal 485 case so do not worry. Its classic case of USCIS ignorance on AC21. I would say, hire a good lawyer and prepare for a MTR. I have seen Ron Gotcher as a very prominent proponent of AC21 rules. You can take his help. I used AC21 and got GC approved without any hiccups. My case was handled by Ron and I have been completely satisfied with his services.

2. Spelling is a logical/creative thing. Its not cramming words from dictionary. Its an art too. Ever heard of phonetics.

Are you quite sure it is a logical creative thing ? There are a lot of words which are pronounced quite differently from the way they are spelled ... unless you know the word ( by cramming ) you would not be able to spell it.

Obviously this is hard work but to what end. How is knowing the spelling of every word in the planet going to help her or anyone for that matter.
Better be a good writer who writes on interesting topics , stories or novels than to be the proof reader for the writer. Who do you think would have a good career - the writer or the proof reader.
Learning how to spell would have taken thousands and thousands of hours . Wouldn't that time be better spent in learning maths or science or arts or a musical instrument or sports or anything that will help her in the future or be personally gratifying for life. I am not sure she will remember half the words 10 years from now just like a engineer doing java programming for 10-15 years would practically remember nothing he learned in college.

This was a good find. The decision actually opens up more doors then it closes.
USCIS in the past; and specifically Nebraska service center would deny I-140's if you did not have one single source degree equal to U.S. bachelors degree (ie., combination of degrees was not allowed).
this decision basically says that 3+2 will not be considered equal to masters but will be considered to be equal to bachelors degree. However, since the labor didn't allow for bachelors and five years of experience then they consider him to not be qualified for the position.
Looks like 3+2 will still qualify for eb2 but through the bachelors and five year route.
If you look through many of the appeals decisions you will even find contradictory stuff with regards to combination of degrees to get to bachelors equivalency for eb2.
That's why when you are first starting the greencard journey it is safest to go eb3 route and then later give it a try for eb2.

My 2 cents - be careful at workplaces and try to avoid discussing about our issues with co workers, 99% of them are ALIPAC, NumbersUSA, Programmer's guild etc....

Having dealt with Americans in the past 8 years, I don't believe they planted evil designs in the current immigration systems just to get the best of us. The problem here is that people in this country have a very strong and almost unstoppable tendency to complicate things. Immigration system is one obvious example. PD date, quota, and ROW, millions of different forms etc. Its complexity is simply beyond you and me. Other examples abound. Legal system, taxation, state / federal relations, college admission, business dealing, etc. Once you reach teenage stage, there is no way you will ever live outside these sytems.
So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. Secondly, a complicate system is a lazy man's product. It's not a big deal if you can design a extremely complicated and all inclusive system. What's great is that you can make it simple and intuitive so even your grandma can use it, while at the same time it covers all objectives & purposes served by the complicated system.
My issue with this way of working is that the more complicated the system is, the more likely it will fail. Look at the space shuttle. Each of the one million parts was probably checked, double, and triple, and quandriply re-checked, but you put them together into the shuttle itself, you still got two space disasters in the past 20 years.
Another consequence of this social pattern is that systems most often get exploited by people armed with specialty knowledge. I guess everyone here paid the lawyers (or your sponsor paid). Same thing for the accountants. These specialists are taking advantage of the fact that ordinary people can not get a handle of the current situations and have to ask for help.

Guys the news is from Yahoo India website. The reporter is for sure homebred for the Indian Express newspaper and you also have to note Immigration is spelt as Emigration there. The reporter must have been an amateur who must have takes notes while on phone without bothering to verify the spelling!

Agreed...it is personal decision...but for Indians...it is a difficult decision. The way India is growing....People who have lived here for more than 10years...are migrating back....i know a person who left...has warned me...just to earn and get out.....not good for kids future etc....

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing ED MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for ED Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?

Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing ED MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for ED Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?
If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future. Even Americans are not fool. And how dare you pretend that people form China and other countries just stop supporting IV as they just see few threads celebrating Indian culture? So stop this bullshit now otherwise I may have to request moderators to ban you.
