What I am saying is, instead of spending N years waiting for GC, I guess we lead better life elsewhere!
Where else, in our home country... but that reminds me of descremenation again!!
So I thought of place which is not in high demand yet... africa...!
I always believe in making things happen, in stead of waiting for someone doing it for me!!

Another important question is: Will USCIS allow AC21 without an approved EAD?
One does NOT need EAD to use AC21. I don't understand the panic.
In fact, one can be working at Employer B and can claim AC-21 for Employer C as a future job.

Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".
This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.
Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.
So.. I think this is how it will work. USCIS might request evidence/letters from you/your "after-GC" employer and if they will find something like your resume that you have sent them before getting GC, then you are in trouble. But if you will demonstrate, that let's say you met your "after-GC" employer only after getting GC (let's say at some exhibition) and he offered you right away +50k salary, then I don't see how USCIS is gonna build their case.

I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.

It was possibility of good strong case by AILA that deterred USCIS to reverse the decision without a formal lawsuit. This is exactly what we need to further our cause. USCIS could care less about other petty tricks. They will only understand language of laws/court. For that we need congress to pass laws favoring us.
Our decision to send flowers was initiated around 2-3 July and the first of flowers were booked to be sent the same day.

We could take the suggestions of other IV members, may be sending a letter is not a bad idea with some extra postage stamps to help out the USPS since they also reduced some of their services due to funding issues. How about sending few $$ donations to the military fund any public fund to be used to spending.
We need to consolidate all these threads in to a single one and start working on it and quickly.

It is like you going out with friends and one of them doesn not speak your language, so wouldnt you speak English to make sure he or she isnt left out and feels uncomfortable?

When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)
Note : Please check with your attorney, I'm just one like you and this is my experience

How can ur case be preadjudicated, yet not assigned to an officer. For my wife's case wea re told several times that her case is not preadjudicated but is with an officer. My case is approved and the officer I talked to said that it seems that her case is with the same officer who approved my case...and that her case is pending possibly becoz of biom issues on my and her case...she said she is sending a request to upload the biom again...wait for 2 weeks...not sure if there will be any positive result but what can we do other that WAIT

The way i see it, they've asked for past emp letter with tax forms and some w2s.
None of those would indicate that you were on the bench.
The emp letter should basically just indicate your dates for employment - start/end date, designation, duties and perhaps salary. that's all.

I have 3 yrs degree + 1 yr PG diploma.
But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
Here is a list of accredited institutions that offer online MS degrees at reasonable tuition:

You can also consider getting a US bachelor's degree through online courses and credits-by-testing from one of these:

List of Programs Available at Charter Oak State College (http://www.charteroak.edu/Prospective/Programs)
If you do an official evaluation of the 3-yrs degree that you already have, it can be equivalent to up to 90 credits from a US School (which is equal to 3 years of undergrad education here). All these credits may or may not be transferable to the school/degree that you choose to enrol in. But you would have to research and find a school that would let you use most of them. That way you can complete your degree much faster than the standard process.
Whatever you choose, make sure that the school is regionally-accredited by one of these organizations:
CHEA: Directory of Regional Accrediting Organizations (2009-2010) (http://www.chea.org/Directories/regional.asp)
Remember every long journey begins with just one baby step... Good Luck!

I agree with you.
We do not have to go and sit down in their helluva offices to figure out what the heck is going on. My point is simple. As long as all the so called companies simply write software,provide services to US companies its back office. How much of software written is for native use? How much of the revenue generated by these companies is Indian based? With out infrastructure and manufacturing growing at at least 10% of the other growths people dream about, its nothing but a deck of cards doomed to fall any time. Enough of my rant.

Nothing significant is expected from this speech. Most politicians repeat the same 3 things- Secure our borders, provide path to citizenship to millions and welcome best and the brightest. The real question is when they will do the real work on immigration. There have been some discussions on administrative fixes on immigration. However some of these fixes would politically harm democrats in the upcoming elections.
Only when the democratic party weakens things can move forward for the skilled (EB- GC ) folks. Democratic party is never for skilled immigratiion, it is all for illegal masses only.

I came here as a guest, started reading the forum posts. Later realized some threads like 485-Filing and EB2-EB3 predictions require membership. Once I find the membership is free, I registered as a member. After couple of months, I realized what IV could do with my contributions and then I became a donor. So we need free access to bring new members to the forum and to show how they can help IV to help themselves.
Free means one gets all kinds of public answers hindering IV's efforts.
