Went for first interview on 4th Jan. Got confirmation email today 15th Jan 2008. Got this email about an hour back.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.

This is good but the numbers are very less to do anything in the bigger picture(EB2+EB3 pending). Atleast something is better than nothing.
Hope this doesn't lead to laxing on the advocacy day agenda or less efforts from EB2 people on the verge. EB3 people stuck wtih pre -perm labor, no substitution should also be helped, and way to do it , recapture of unused numbers, hold on diversity lottery. Going through advocacy efforts. A united effort has a higher chance.
It may not have any impact on EB3 this year...but once the EB2 is cleared it will have an impact on EB3; may be in a year or two.

Hi I had contacted the KCC number but they said they could not provide any estimate and said I would have to contact the concerned consulate at India to check on the status.

I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Take your I 485 application. There is a received date column and Notice date column.
Date received is the date they received your application,Notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08MAY2006 (EB2), but with a notice date of Aug 30 2007 will get the green card earlier than someone with priority date of 20April2006 (Eb2) with a notice date of Sept 15.

Actually I thought they will not accept flowers. But for courtesy and humanity touch they are forwarding. Because of these atleast flowers have some purpose without wastage. This campaign will not have any impact on functioning of USCIS as they are following law. These mistakes are common in every Government organisations and time time mistakes are being corrected. Even congressional hearing happens and finds mistake they will prevent future mistakes like this. It is unlikely for affected persons to get relief immediately. But Many persons will get relief automatically on oct 2007 when DOS sets Cutoff date. I expect cut off date for EB3 2003 or 2004 and for EB2 2005.
Correct me if there is a misunderstanding due to culture differences.

I raised SR on Aug 12th..No Response Yet...
Infopass appointment said that my file got assigned to Examination officer on Aug 4th...Not sure if Examination Officer and IO are same or not...
But the real kicker is i got second FP on July 26th, 2010 for Code 1...I didnt see any LUD after second FP...I am guessing this is where i am stuck with second time name check or back ground check verifications...
Also is it good to go for DHS 7001 form right way...i mean ombudsman request...
I will propose that you call USCIS customer service and talk to a 2nd level officer to find out the status of your case.. It doesn't hurt to pursue from this point.
I am unaware of any concrete proof that contacting Congressman or Ombudsman has actually helped directly...Most of us are just speculating on this.
I think you need to hear the fact that your case is assigned to an officer..Then it is just a matter of time.

Any body know why there are 3341 cases in March 2005 in EB2 I category, is this about the time PERM came?With out quarterly spill over bulletin is going to get stuck in March 2005 till the end of the USCIS financial year.
Yes, PERM was introduced on 28th Mar'05. I guess the high number of EB-2s was due to employers rushing to file under the old system.

That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.
Gurus, correct me if I am wrong.
I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
IV has not done anything that could have a negative impact on your green card processing. IV is striving hard to change your lives.
Shame on those who are scared or pessimistic. All you people do is to gaze at the sky and wait for the stars to fall.
If you are so scared - how will u raise your children? What will u teach them? Cowardice? Will U teach them to run away from issues? Will u teach them how to not cooperate?

I agree nobody cares...for now, from experience i can tell you that i have advised most of my juniors to try MS in Australia, they can get an Aussi citizenship faster and most have listened. I am sure i am not the only one saying so, this could and will eventually affect the number of students(and the quality) coming here for MS/Phd etc, agreed that US is still the best place for a post graduation but the visa hassles of getting an EAD/H1/GC is not worth the effort, most of the students coming in will be over the hill in terms of their growth by the time they get the GC, if they get it in the first place...imho. I have had friends in EB1 NIW stuck in a mess for years.
IF you talk to the kids working in indian companies, most will tell you that they want to come to US for short term projects. Most know the mess that we are in. Sometimes we are so preoccupied with our issues that we are not aware that the world is watching us and learning from our mistakes

OP should try to pursue this through a lawyer if s/he can. For the rest of us, maybe time to think of what we can do together to not face this again in the future. Lot of us are going to be on EAD for a while.
