It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D

About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.

There are questions commonly on the minds of many Murthy Law Firm clients, as well as the greater immigrant community, that involve the effect of reentry into the U.S. on those who hold H1B or L-1 status as well as having approved Advance Parole (AP) based upon pending applications to adjust status (I-485). The law pertaining to this situation is not clear and the result is confusion. Thus, many with both H1B (or L-1) status and AP find themselves faced with the difficult decision of how to reenter the U.S. after travel abroad. One must decide between reentering in H1B (or L-1) status, which requires that the passport have a valid H1B (or L-1) visa stamp or utilizing the AP document. AP does not require an approved visa at the U.S. consulate. Such individuals are concerned about the manner they choose for reentering, as this may affect their respective status in the U.S. Answers to many of these questions are in our MurthyBulletin article, Adjustment of Status and Travel : Your Questions Answered! As a matter of precaution, since the above information is based on a long-standing Legacy INS memo, rather than law or regulation, it may be advisable to possess an EAD in this situation, in the event of any questions on the issue. However, even in that scenario, the employer would not seem to have any additional I-9 obligations, as the last document reviewed by the employer (H1B or L-1 I-94) would be unexpired. Also, the employee would be allowed to file for the H1B (or L-1) extensions even after entering on AP.
Parolees Resume H1B (or L-1) Status upon Admission or upon Approval of H/L Petition
The May 2000 memorandum clarified that an H1B (or L-1) nonimmigrant, who has traveled abroad and reentered the U.S. on AP "may apply for an extension of H1B or L-1 status, if there is a valid and approved petition." If the USCIS approves the petition, this "will have the effect of terminating the grant of parole and admitting the alien in the relevant nonimmigrant classification." The same effect would be achieved if the current employer files an amended petition. It can also be achieved if the individual works for the H1B employer, and later seeks to extend H1B status through a change of employer. Additionally, since the AP entry does not invalidate the approved H1B (or L-1) petition, the foreign national potentially could regain H (or L) status by traveling abroad and reentering with a valid H (or L) visa, and obtaining an H (or L) notation on the I-94 card at the port of entry. In these circumstances, the H (or L) status will be reinstated, giving one the benefit of continuing in that status for a length of time even if the I-485 ultimately is denied. Thus, when one wishes to maintain H1B (or L-1) status, which is often the case, this still may be accomplished, even if AP is used for entry at some stage in the process. This is particularly straightforward for individuals who have H1B (or L-1) status that will need to be extended shortly after their reentry into the U.S. The H (or L) extension, if approved, will put them back in H (or L) status, even if they last entered on AP. This can financially drain you out. My insurance agent told me that they cant get the money straight out of your bank account , because how will they find out your bank account number and the bank? How do they know how many bank accounts you have? What if you send money to India before the judgement is entered against you? If you have a house, they can go after your house or car. What about their own insurance policy? Maybe their insurance can also pay as uninsured motorist pay? Retirement income is usually protected in some states and hence I dont think your 401K is at risk. Once your insurance company pays out the maximum, you can basically say hands up, I have given up.
I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.

I dont have problems with genuine L1s who wants to settle down and apply GC. But 90% of L1s, just come for 1-2 years, take away jobs to India, drive down wages and never interested in settling down
Don't you realize that this is the preferred policy of a large part of the US establishment? The anti-immigration activists are concerned about demographic change and are thus okay with jobs being sent abroad in exchange for limited permanent immigration.

@buddy thanks for this thoughtful insight, and i am also not looking forward to any transfers as i tried it with one employer who wanted to hire me but so late as it has been the procedure didn't get through.
Well about him not closing down shutters i know it would be difficult to indict him to that level, but even for him to hire an attorney and fight to save his A** would be a greater achievement and moreover once i am back to my native, i will blacklist him as much as i can in the forums and in the immigration voice. I will make it sure he doesn't get any goat to butcher from my native land any further.
All i am seeking here is that even if DOL launches a investigation and he loses his money over it during his trial and if everything goes well (as i am preparing every doc , every communication, every letter that he sent me to prove that these consultants are all looking for money no matter even if it comes in the form of someone's blood) my job would be done. Hopefully DOL will tighten some screws somewhere and maybe i can save one more like me to fall into the trap of this company.
I would be constantly working to make sure if someone types his name , my reviews of his blacklist appears before his company website, i have done many SEOs for many companies and my friends i am capable of destroying him at least over the internet and i shall see to it that happens.

hi,
my parents will be travelling to the US in a couple of months, and I was looking for health insurance for them. Based on various forums, looks like US companies are preferable to insurance bought from india (and as per forums, ICICI lombard seems to have the most negative reviews among the indian firms).
Anyways - has anyone used insu buy .com to buy medical insurance for their parents, and had to make a claim? They seem to be an insurance broker -- so the insurance company will be a third party, but they (insu_buy) seems to claim that they will also help out with claims in case of any issues.
Anyone have any experience buying + claiming insurance via ? (and if so, what was the insurance company that sold the claim via ?)
I searched immigration voice forums for "insu buy" but though there are many threads about medical insurance for parents, there doesnt seem to be any mention of -- so any experiences shared will be helpful.

I know in Canada and UK taxes are high but when you need services NHS and other agencies are always there to help you and protect you. It takes 1000 days in Canada for parents to get PR and after PR they are all eligible to use Canadian free public health system.20000 pages of new Obama's health care reform and it does nothing regarding pre-existing conditions, immigrants,high deductibles and aged US citizens.Even full time employeed people with employer insurance really have to fight very hard to get their insurance pay for necessary medical services in US.Its because all insurance companies are always looking for bogus and false reasons to just deny even ligitimate claims.
I strongly suggest all indians and immigrants to please dont ever grow old or sick in USA otherwise your American dream will give its real nightmare reality.

its clearly written in Sep'2008 bulletin. However, seems like EB3-I wont' get any of it and all numbers will be given to EB2. we loose again.
Its all EB2.
They even can't think logically that 5+ yrs of difference between EB3 & EB2 makes EB3 automatically same as EB2 as per their qualification definition.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you need more info on this let me know I have gone through this and waited for almost three years to file for my spouse I resheduled my FP notice in 2004 to get married by the time my wife came retrogression kicked in and waited till June 2007 to file for my wife. I'm part of that 10% that you're speaking about. Are you? Have you joined your state chapter? Did you march in DC? Are you a regular contributor?
What's wrong in using Gandhi's name? Are you allergic to the great man?
Any day a Gandhi quote is better than the - 'This can't be done. That can't be done. It's all in vain' statements, which are highly negative, demoralising and triter than the usage of Gandhi. At least Gandhi quotations are positive and uplifting. And we need that here to balance the pile of the negative statements that get posted.

Well then why dont you picket against NumbersUSA, programmers guild et al too, i can name 20 conservative radio shows try emailing/talking them to change their opinion. I say this because i have emailed to a few and even tho they understand my point of view they will not change something that gets them ratings and propagates their cause.
IV has 25k members, i guess 10% out of those are really motivated to participate and ready do something, if you start diverting your resources towards such issues your team will not have much motivation or people remaining when you really need them to do something. IMO

Just got back from the rally, i would say it was a big success. Media coverage on the issue was fantastic. I saw the ABC7 news truck. There were many reporters from SJ Mercury news, SF Chronicle etc. Crowd was good, dont want to speculate on numbers yet but we should have an official word soon.
Police were very friendly. The crowd was very enthusiastic and also obeyed the rules. All of us stayed on side walks. Logiclife and Frankilin among others were there. Many reporters spread out and spoke to people.
Lot of members from another groups called Immigration Rights also joined us.
We got lot of honks. !!!!!!!!!!!!!!!!!!!!!!!!!1

No one know what goes in the consulate office but what you can do is call the local vfs office and tell them what happend and ask them to see if the consulate has handed out ur PP to the couriour company. They might have some information for you.
