    Yes you said it right. See if IV can come up with some provision to encourage those who have expressed to shell out only few dollars. It doesn't look good critisizing those who have expressed their geniune feelings.

    The question here is not asking the Poster to donate more but rather tell him the provisions to contribute less as well.
    No two individuals are at the same thinking level. so his thoughts are that he can contribute less frequently if allowed. So let him know how he can do that. There may be many in the same boat like him.

    For the sake of generating more funds, let IV act like collection agency and look at the member as a customer/defaulter(those fence sitters). Collection Agencies make all sorts of efforts and provisions to collect money from these people. Finally they end up some how getting the money paid. There could be a payment installments based on the capability, lesser or higher amount, reminders etc. I am not sure if this anology is good for IV or not. The ultimate goal is to generate funds with the willingness from the members...


    You gave perfect examples here. Let's take a close look.

    If you think the atterney fee worth $10, you wouln't hire an atterney asking for $6k. Samething with the restraunt check. Samething with IV contribution. If you think $100 is too high, you don't pay it. But if you think it worth $10 you simply ask for it, like everybody will do. Imagine a car saleman responds to his potential buyer's request to a lower price of a car with insulting remarks, he'll loose this customer and many more.

    And IV ALLOWED everyone ...? You went too far, pal.

    Welcome back, the only way we can see progress is by getting some bills passed. Lets all work towards getting something done with the logfren bills.

    Guys,
    I think all of us EB2 ( including yours truly) are guilty of too much analysis paralysis of EB2 visa no.s for the remainfer of FY 08. With today's post by a lawyer on DOS communication to USCIS to stop allocating visa numbers to India/China till OCT 1 , 08, it is clear that USCIS will never get its act straight unless we are completely united and press on for a major drive to senators to pass the visa recapture bill ( regardless of EB2 and EB3) . So let us start flooding the senators inbox, voicemail and email with letters urging them to pass the recapture bill. To that extent I request all of you double your efforts. The next session of senate, which starts next month, is a short session and we should act NOW. otherwise nothing will happen until late next year.

    From what I can gather, from the immigration perspective:

    1. If you are on H1 - You can technically start a business but since you cannot "work" towards it, in practice it's almost impossible

    2. If you are on H1 and have an EAD - You can start a business. But if you use your EAD, you are no longer on H1. (There are contradicting views on using EAD for PT while still maintaining H1. For now, this is a grey area)

    3. If you are on EAD -
    a. If you plan to work on your business on a part time basis and stay with your sponsored job full time, I don't see a problem with this.
    b. If you plan to work on your business full time, you might have an issue with a RFE at the I-485 stage as you would have used AC21 for self employment (Some people say this is okay, but it depends on your risk taking ability)

    Thoughts?

    What about when u start the company on your spouse name and you work through it...I guess that would also be considered as self employment

    AC21 has nothing to do with EAD.
    Correct.

    However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

    Otherwise 3 years extension

    2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
    Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

    uscis works in funny ways (as we all know). As I stated in earlier post one case in nebraska i know got rejected and they stated that the appeals decision wasn't precedent. The texas cases received rfe's but got approved based on the decision.

    Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.

    The Employment Based Immigration section explains how they will make a task force to prevent illegal workers from being exploited. I don't see anything for legal EB workers other than this 5 year thing which will start counting after this law is passed. :mad:

    It says 5 years preceding from the date this law is enacted. Does this not mean that they will look 5 years back from the date this law is enacted?

    Also i do not see them say it is for illegals only...

    I do not think they would make it easier for illegals than legal residents.

    I am not very optimistic about this . But i would definately like to see this pass.

    You have it all wrong. Your experience or qualification DO NOT QUALIFY you for EB2. It is the requirement of JOB that matters. GOT IT.
    Now go scream your lungs out in front of the Capitol, Yelling "DISCRIMINATION".:mad:

    Well this is a good point, and a true one: The requirement of the job. Before PERM, in many cases, the employer was willing to consider an EB2 if the candidate qualified for it. For those who would have qualified, but were put into EB3 on grounds of job requirement, it can feel very frustrating.
    i am sure there are cases where the employer-lawyer nexus has taken advantage of the backlogs to retain an employee. Let us focus on this, instead of trying to look at 'discrimination'.

    End of the day, we'd like to have a transparent process with flexibility to change jobs, so that we get the best for ourselves.

    EB2 or EB3, if any one moves well, can be good for the other category in the long run.

    The idea was to make it easy for majority folks who work in Manhattan and surrounding areas. We were also concerned that the tri state folks travel long distances and work long hours during weekdays will need the weekends for themselves and a Friday night after work must be the best time.

    But, yes, based on majority of the folks's response, we plan to do one more on a Saturday, but not in Flushing, location will be decided soon.

    ok. i live in queens and work in CT. manhattan on weekdays does not fly for me. if anyone wants to meet in the hindu center on holly av. on sunday evenings please let me know.

    if nothing else, maybe prayer will work.

    Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..

    Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

    When adding my wife to my medical coverage provided by my employer, my wife was pregnent, I did a bit of reading up, most of the group insurance policies offered by employers does not consider pregnancy as pre-exisitng condition. That is the major benefit of group insurance policies. If your husband is working in the west, Kaiser
    is the way to go!

    As mentioned in the above post, employer should offer CORBA, which can be your backup.

    Always remember that tough times will always pass!! just hang in there!

    Invoking AC21 is easy, but you need to know what you can expect and how to resolve it

    (1) If you decided to change to new employer using EAD - there is nothing you need to do. Just join and work.
    (2) As employer is asking what they need to do - tell them they need to provide an AC21 letter of support - you can find various formats on the web.
    (3) Your new job must be in same or similar category.
    (4) Call customer service to verify your address on file - also hire a personal attorney and make sure they file g 28 and have them on file too for USCIS communication
    (5) Your AC21 letter may/may not reach your file depending on the service center, officer and a lot of other factors.
    (6) Usually most AC21 cases go through just fine unless your ex employer requests a revoke on i 140 - in such a situation you may get an RFE, NOID or a straight denial on 485 - nothing to worry about - you can resolve all these and you will find yourself back on track.

    I second this. It will take 1 more year for USCIS just to come out of 2001 for EB3 I unless 5882 passes!

    I kind of agree with you. Hope USCIS starts moving faster on applications at-least after that 1 year time frame.
