the revised version is more pointed.
Here are a few other points to consider and highlight:
- That the woes of legal high skilled immigrants are completely forgotten
- Despite the fact that they pay taxes, social security etc
- They represent a continued American heritage of immigrants chasing the Great American Dream
While H1B workers might appear to 'displace US workers', the crux of the issue is that in order for US companies to remain innovative and competitive they cannot afford to take a hoary protectionist policy in talent management.
High skilled talent finds level ground, wherever it might be.
While the old world order was about national boundaries and international competition amongst countries, the new world order is about a flat world where transnational collaboration and commerce can enable wealth and job creation in any part of the world!
The presence of high skilled foreign workers INSIDE the US
- ensures that jobs remain in the US
- ensures that resultant taxes remain in the US
- ensures that resultant investments target the US economy
- apart from ensuring US competitive and commercial advantage
The oft repeated arguments about 'local talent being available but not tapped' is borne out of a sense of elitist entitlement; something that runs counter to the great American Dream and the quest for constant innovation, creation, improvement and execution.
The need of the hour should be on how to enable successful assimilation of high skilled labor and talent into the US economy such that the economic engines of efficient productivity are not hampered by artificial tarrifs and barriers borne out of a broken immigration system.
The quest for a color-blind, talent-oriented, country-agnostic immigration system has a long and sometimes troubling, history.
While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.

They moved from 8/1/2002 to 9/22/2002.
According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
Never mind the spillover, can ROW just get its normal quota at least?

Obviously,
Can you make what you wrote here in your reply in a form of a letter and create a petition to be signed by IV members ( just like this petition fighting Lou Dobbs). then your petition will be mailed to all media outlets. I really like what you wrote and I think if baked by IV we can sign it as a petition and send it to explain our cause to the media and the American people that might not be aware of our situation.
Thanks

If you have high ethical standards then you will call your company and tell them it is wrong. That what you do, instead of painting everybody (indians) as bad. I came here on F1 studied here got a job in campus interview. I could have gone to a desi company and earned about 20 % more than what I did, but I did not. its left upto each individual to take his own decision.
I resent this thread which asks, are we responsible for this. Who is "we", certainly not me and certainly not a lot of hardworking and honest people.
Thats what I meant when I said stop responding to this nonsense. Are we going to have a discussion on every negative thing the anti - immigrants say.
My company posted on Dice&Monstor, 10-15 versions of my resume with diffrent combinations of my first name/fathers name and Last name.....
They call it..."Marketing" your profile!!! The American recruiters who knows me, use to call me & tell me that they have "hit" of my resume with names like...A.ASH or S.ASH or H.ASH...and so on..while the content of my Resume remains same!!!

Here's another question -
"Illegal immigration has been a topic of heated debate and has received much needed attention during this election. In the midst of all the hype and bickering about ILLEGAL immigration, there is a group of people, often forgotten and ignored, who are caught up in a bureaucratic mess and yet are patiently waiting on the path to LEGAL immigration. This is a group of high skilled workers, most of whom have advanced degrees in medicine, engineering and science from Universities in the US. These people have obeyed all laws, worked hard, paid taxes and waited their turn, many for a decade, because of a system that is hopelessly broken and inefficient. I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card. As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? Please note, this question is NOT about ILLEGAL immigration but about LEGAL immigration."
I voted for both. Please do the same.

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!
do you have SR opened for your wife?

FOR ALL THOSE WHO VOTED YES - IF WE HAVE ENOUGH NUMBERS WE CAN CHARTER A A380 OR TWO DREAMLINERS ONE FROM THE EAST COAST AND ONE FROM THE WEST COAST WITH STOPS IN DIFFERENT COUNTRIES TO DROP OFF PEOPLE. IT HELPS US, AIRBUS/BOEING AND THE "NO" SAYERS WAITING FOR THEIR GC'S. THIS WOULD BE FOR SURE A BIG EVENT IN THE HISTORY.
most of us came here to save money. Blowing away all our savings by chartering a A380 on the way back, is kind of ironic... 7 years in the US and all I have to show for it, is this T-Shirt saying I flew on flight IV-A380.
(just a joke, please spare me the flames)

Well said, Logiclife. Life is a movement, fight. You won't get much (if anything at all) if you just wait for someone to give it to you. You have to get it.
Except the native Indians, everybody in this country is an immigrant or a discendent of immigrants (and many of them illegal, btw, but they quickly forgot that...). But once they settle, the ex-immigrants immediately start putting hurdles before the new immigrants - laws of nature! Now we have: "Immigration is a privilege, not a right" :-) Come on!
Our case is a tricky one because we do not have enough leverage to push the government to resolve quickly the mess it created with the backlog and the retrogression.
The only way to fight it is to expose our case broadly via the US media. I was promoting this idea since I joined IV. In the beginning I was critisized for that since the core group thought that lobbying was an universal tool but later they changed their mind. So, I deeply believe that broad media coverage can only help solving the legal immigration mess.

caliguy,
I am in same boat as you.
2 i-140's approved with same company, both are EB2, one is RIR one is PERM.
PERM one had Jan 2006 PD where my RIR had Nov 2004.
I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.
leoindiano, I too have exactly same situation. Two I140 both EB2, one RIR (Nov 2004) and other PERM (Jan 2006). I called Nebraska SC using POJ method and verified with them if both 140 are linked to my 485 application or not. IO confirmed it over the phone and then reiterated that later PD is going to get picked up so my case is current per them. So, I would suggest that you do the same thing.
Another thing is that, after opening a service request, you can send a followup email to ncsc email address and get your query about priority date answered . I did that too and even got response from them . (Both A# consolidation and difference in PD)

This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.
My suggestion - You can not play safe your whole life.
After an extensive research on internet about all this I will expose my case to hear your opinion.
I'm on my EAD second renewal now, Have approved I-140 and my PD is Dec 16/2006. Si according to waht you say I can walk away changing emplyers and get another job or either a part time job???
My current attorney wont give me any advices because she says is against the law because she represents my employer and me so she recomends to look for another attorney.
Since I have an EAD my wife was able to work and things turned better but this year with the economic situation and a baby I'm about 5k short and I'm being very careful and looking for a wild card just in case.. Someone told me I can get another H1B and start over even If I have passed the 6 years of H1B.
Any thoughts?
Appreciate your help

Oh really? do you think so? RBI controls the exchange rate. You know who control RBI? Banks like ICICI and big corporate companies like RIL etc and other biggies and also big IT comps.
You seem to believe in all the conspiracy theories out there. India is no more a third world country. There are many deep pockets and if there was any such arbitrague existing people will mint money all day long. Rupee is not fully floating currency that doesn't mean you can control what the exchange rate is going to be. No company or congolmerate can manipulate market like that.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,
>who cant vote and
>who cant contribute to his election campaign
what is the motivation for the law maker to support the bill
So to avoid sounding stupid and foolish and desperate when you call a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members login and sign the forms digitally
b) Then have IV reps.. fax them and send them to lobby groups .
c) Lawmakers will listen to one talking headand not worry abt 1000 calls that borders on ..saar support the bill saar..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess . And its a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!
if you don't call and speakup, how will the lawmakers know?
your suggestion sounds great. I am sure we can accomodate that too.
Its better to have attack on many fronts than stick with one.
We need to rise and speakup, thats all matters in the end.
