    I can confirm that DC allows you to renew online without looking at your immigration status. If you live in DC, make sure you renew online as I got it renewed for 4 years online.

    IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

    The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

    It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?

    The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

    Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
    Now only people who have studied or worked in Canada on work permit are eligible.
    family based is greatly restricted unlike US where around 80 is non-skill based.
    If they want they always reform but the exiting H1B is so good for American Companies that they will fight to keep the existing H1B-GC servitude instead of
    any point based..

    Plus there is politics of vote bank: Moment the CIR comes, the sheer stampede of illegal lobby like the bulls of Spain, H1B folks get crushed. Last time, moment the CIR came, H1B people started opposing it because it literally made illegals ahead in line line with more points in the point based system.

    That's why I am skeptical of CIR as of now. H1bs don't have much chance in front
    of the madness of illegal lobby vote bank. Based on my observations of how the
    US politics works I don't see promise in CIR (one of main reasons I left for Canada)

    Not to mention, a lot of antis are not that against EB reform but moment CIR comes
    all anti-s get united in opposition. The illegal bobby hold H1Bs as hostage unless they get what they want. It is such a deadlock that I just don't see how it can be fixed.
    Unless there is another super powerful lobby helping us like US industry (supreme powerful lord in US politics) which currently wants the existing H1B system I don't see headway.



    PS: In 2002 Canada passed IRPA where they delegated the rule decision making to the executive branch unlike US where any change has to be legislated.

    it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)

    Based on what?

    EB1 is more qualified than other categories and is seen as someone who is in a better position to contribute to the national welfare of the country. EB3 is the least qualified of the three and is also the most likely candidate to displace an American.

    And you think America should throttle the flow on qualified EB1 and be more generous with EB3?

    EB2 is different however. Most EB2 are people who were EB3 earlier (like myself). For such people, there is a provision to upgrade to EB2 through interfiling - as option that is being heavily used even as we speak. So where is the problem?

    Good to hear that 01, 02 & 03 ppl r getting approved. Atleast they are following FIFO and the line is getting shorter. Not that I am not happy abut the 06 folks who got GC but it should realistic 'First In First Out'.

    The only problem with this is as follows. You are either FIFO all the way or you are not. When you are FIFO by convenience, then the result is multi year old 485s, and volatile PD movements that make the stock market gyrations seem minuscule, which is clearly not the intent of the system. Where was FIFO this summer when they were shooting random approvals from the hip? How can you say FIFO for come and luck of the draw for others?
    I am especially glad to see the older cases getting their due, but they have most certainly screwed some ie those with 2004/5 PDs, especially those at the NSC by their policy this summer.

    If AOS takes many years, then keep the non-immigrant visa, so that no need to worry about AP.

    You are suggesting how to avoid it rather then try to acknowledge that there is a problem in the wording of AP. By problem, I meant the whole dynamics has changes over the years, so, its time they change to reflect today's reality.

    There may not be everyone who would continue to be on H1 while their AOS is pending.

    Thanks for your reply. Everybody else is just teasing and making fun instead of answering a simple question.

    (1) Are these steps taken in a sequence?
    (2) Does USCIS update the status of our file so that we know where we are i.e whether our file is stuck FBI Name check or FBI Fingerprint Check, etc..


    After receiving your I-485 USCIS conducts the following background Checks:

    IBIS - Interagency Border Inspection System name check
    FBI - FBI Fingerprint Check
    FBI - FBI Name Check
    IDENT - Automated Biometric Identification System
    Other biometric checks - For some cases, USCIS itself conduct comparisons of photograph, finger prints and signatures stored in paper application with ISRS.

    You have to clear all these checks (some of them has expiry as well) when your PD becomes current.

    Till then keep renewing your EAD / AP. [I think this is the milking cow for USCIS :) ]

    I mean Did you earned your MS after 3 year degree from India? In short Does ISU offer MS for 30 credits for person having 3 year degree from India?

    I think If any Univercity needs total X credits to finish US MS then that univercity counts How many credits (Y) one has earned from his past education. So X-Y gives how many more need to earned to finish MS.

    ISU - Iowa State University; Not from India. Yes, $15K for a total of 30 credits. Aprx 3 credits per subject => total 10 subjects. One of them must be a project, so total of 9 subjects ( with 3 credits each).

    It shows that the interpretation of law is not same everywhere.
    some people get it easily and some dont. Bridgeport, CT DMV is very crowded most of the time and tough to get things done. There are a lot of people of a kind that come there and it is tough. you must try Westport etc kind of areas next time.

    Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

    This is one of the biggest bottleneck to 485 and naturalization processing. Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

    I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.

    Sorry to hear about your experience. I personally have used AP three times within one year. Two trips to India were of 6 weeks and 4 weeks duration and one to Canada for 4 days. I have never faced any problem, having used three different entry points. During my latest entry just a couple of weeks back I wasn't even asked any question at all. In fact my GC was approved while I was out of the country. Just your bad luck to run into this officer, I guess.
