i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

It is not possible to have 600K total pending cases (= EB + Family + Asylum + Refugee + ...) cases because there were 1,275,795 pending cases in March (according to Ombudsman) AND it is not possible to give 600K+ GCs in 3 months: EB + Family = 140K + 226K = 366K.
So my understanding is that there were 600K pending EB cases in June. Does family-based GC application have I-485 stage?

Can some of experienced guyes answer my question about the DISABILITY INSURANCE.
Some of you guys looks like confusing DISABILITY RIDER in the TERM/WHOLE policy with DISABILITY INSURANCE.
DISABILITY INSURNACE will pay for (in Most case 60% of the last salary) if you become PERMANENTLY DISABLED and can not work up to the age of 62 or 65. After that SS will pay for you.
DISABILITY RIDER that you have with extra cost in the LIFE INSURANCE policy cancel payment requirement of your Life Insurance policy. So If you become Disabled You WILL NOT HAVE TO PAY PREMIUM for your TERM/WHOLE Life policy and still it will be effective.
Because of my one of the diseases I am always worried about DISABILITY insurance.
I always try to get Short term and Long Term disability insurances through employer.
But the problem is they always start with long preexisting exlusions and when you change jobs they dont continue so have to start new one which also has other new preexisting exlusions to start.
You can convert your longterm disability to the personal policy if you have that for long time. but they are not valid if you get new job.
Is there any private/personal (not employer sponsored) Short and long term DISABILITY Insurance policies that we can purchase out side of the job.? How are the premiums? Are they reliable?

I work for Fortune 100 company and we are celebrating Diwali on Friday. There are flyers on all the corners and are expecting more than 500 co-workers for pot-luck lunch. And the best part, organizer and main activists are non-Indian. So its just another festival in the mix that everybody is looking to enjoy. This is our first gathering followed by 4-5 more before end of the year.

I personally am not questioning Robinder's achievements/accomplishments. I am glad that the media mishap is ironed out and it ends there as one of our member said. No one has personal grudges here. You have been a member of IV from 2006 and know Robinder to an extent where you can go on a limb, how come you havent pushed him hard to support this, if not along with IV, but on his own. I have been visting a lot of immigration related internet forums for a while and I never saw any efforts towards this from any American Indian Citizen community. It could just be a coincidence that I might have not noticed any such efforts. I am more than happy to end this discussion here and stop retrospecting. The media mishap has been clarified. Lets leave it there, unless the American Citizen Indian community wants to do their part in achieving our common goal.

I can understand cases where dates are current. But how they decide on cases which might have "visas available in coming months"? Do they know beforehand the movement of dates for coming months? or does that mean they continue pre-adjudicating cases in an order (probably by Priority Date)?

Few months back, 2 DMV officers gave me a tough time in CT. I wrote strong complaint and got a reply that, it will be allright if I go again and I went for the 3rd time and got it without hasstles.
Here is what happened
Dear Mr. XXXXX,
This reply is in response to your email of 5/20/06 in which you
describe
the difficult time you have had in obtaining a CT license. Please be
advised that if the documents are not acceptable when you return you
may
ask the Sergeant or Supervisor to complete a form for 'Review of Non-US
Citizen Documents'. In this process copies of your documents are
forwarded to our Branch Operations Division for further review. You
will
be notified of the outcome by mail.
Thank you for taking the time to write and bringing this matter to our
attention.

employer is based out of Irving, Texas and I am employed fulltime with
them. My company sends me on work assignments to various clients all
over the United States. I recently started on a work assignment at
Pitney Bowes located in Shelton, CT. All this while when I am in United
States, I have worked in the states of Georgia, New York and Washington
and have obtained drivers licenses from all these states. I have
maintained legal status and always carry my documents whenever I
interact with a govt agency like DMV.
From the time I have started my work assignment in CT, I have
approached the DMV twice. Both the times I was turned back saying that
my documentation is not acceptable.
First experience:
DMV, Bridgeport, CT:
Issuing officer wanted a document from my employer that says that I
am still employed with them and have not switched employers. I asked
the
officer polietly if there is anything she is expecting to see in the
document (in terms of information like kind of work, nature of work,
place of work etc...) and she was very kind in explaining to me that
all
she wanted to know was if I actually work for the employer who holds my
visa. I told her that I will come back again with the letter.
DMV, Hamden, CT:
After obtaining a employment letter from my employer I chose to go
to DMV, Hamden, CT because it is close to my home. The issuing officer
looked at all my documents and then told me the employer letter was
unacceptable because it is generated by a computer. I asked him what
document is he actually looking for. He said he cannot accept a
computer
generated document. I was confused. Then he showed me my employer
letter
and told me he cannot accept it because it is printed from a computer.
I
told him it is generated from the computer so whats wrong with
employment letter generated from a printer connected to a computer. I
understood what he was trying to say. He just had concerns with the
validity of my employment letter.
Nothing wrong in having concerns about validity of employment letters.
He was just not able to express that to me. As I have the habit of
carrying all my documents, I showed all my legal documents like LCA
(that I am working in Shelton, CT) , my h1b documents etc... to make
him
comfortable of the fact that my employment letter is indeed valid. But
at this point he just did not want to listen or see anything instead he
kept arguing that this is CT and rules here are different and he would
not see any documents or papers and he only wants an employer letter.
And I told him that is right in front of his eyes. He says he cannot
accept it because it is a computer generated document.
Then I asked him what he really wants? He argued that he wants an
employer letter that is not a computer generated document but a actual
document. Then his collegue came to his resque and told me that he is
actually looking for a document that explains clearly the reason I am
in
CT and details of my work location from my employer etc... I asked him
to write it down in a piece of paper what he actually wants. His
collegue wrote down in a piece of paper that an employment letter
stating my work location as Shelton, CT is what they are looking for
and
I can get my out of state license transfer once I have that document. I
wanted a official letter from the issuing officer stating what they
really want and they were not willing to give me that. So I asked him
again what he wants next time. He said he wants a letter from my
employer that I am working in Shelton, CT and work details etc....

documentation required. The best thing to do to check validity of h1b
visa holders is to actually ask for recent paystubs and w2 forms. These
forms have employer names and if any H1b visa holder. If the issuing
officer has concerns with documentation validity of a h1b visa holder,
then the best thing would be to have a employment background check done
or look at paystubs and w2 etc... Or specify what kind of letter they
are looking from an employer so that they can be convinced that the
candidate is a valid visa holder.
Though I will be going back to the DMV sometime next week with letter
they requested for, I felt it is my duty to suggest to DMV a good
source
of validity for h1b visa holders.

Dear valuablehurdle,
You need to understand why your company is paying only 85K. Your base compensation is 85K, then you have another 10% on top of that as bonus. Also your Health/Dental/vision Insurance will be close to 15K payed by the employer. Also they pay Social Security at 8% base pay + Your H1B and other legal Expense for you and family. This will put your total rewards/compensation well above 100K.
I am not trying to say that your present company is perfect, but these are the common expenses for a company , Thats the reason even if you get hired by the direct client your salary will not increase very much. Companies pay 180$ to the consulting companies for the following reason
1) You are not their employee, so $180 per hour is all they pay ( No benefits, No H1b Legal hassles etc)
2) They Hire consultants for a particular project for a set period of time. After the project is over, they can have the consultant "released" from the project.
3) They dont want to hire independent contractors, cos, if the guy leaves in between the project, its the responsibility of the consulting company to replace your position with another qualified person.In your case, they need to find another candidate with your technical expertise, which is not very easy.Very few Companies wants to take that risk.

Anyway, I feel there are bad apples......but not all take commissions.
Still, I am at a loss to understand the same company that pays $180 per hour to the American Consulting company will pay me only as much as $50/hr.
What would be their logic?

You need to understand why your company is paying only 85K. Your base compensation is 85K, then you have another 10% on top of that as bonus. Also your Health/Dental/vision Insurance will be close to 15K payed by the employer. Also they pay Social Security at 8% base pay + Your H1B and other legal Expense for you and family. This will put your total rewards/compensation well above 100K.
I am not trying to say that your present company is perfect, but these are the common expenses for a company , Thats the reason even if you get hired by the direct client your salary will not increase very much. Companies pay 180$ to the consulting companies for the following reason
1) You are not their employee, so $180 per hour is all they pay ( No benefits, No H1b Legal hassles etc)
2) They Hire consultants for a particular project for a set period of time. After the project is over, they can have the consultant "released" from the project.
3) They dont want to hire independent contractors, cos, if the guy leaves in between the project, its the responsibility of the consulting company to replace your position with another qualified person.In your case, they need to find another candidate with your technical expertise, which is not very easy.Very few Companies wants to take that risk.

I am not sure why someone said that it is scheduled for 24th.
I've started calling and made first call to the chairman's office. I told the man that I'd called to express my grattitude and thank the chairman. Then I requested the chairman to take a yes/no vote on this bill and to take the bill to its logical conclusion, at least in the Jud Committee.
Please remember, "thank you" packs awesome power and all members should convery their thanks to the chairman and request a vote on the bill for logical conclusion.
I have not finished calling yet and I iwll update the poll only after I have made all the calls. From this thread it looks like the hearing is on 24th. If that is the case I will make the calls tomorrow so that I could actually talk to someone.
