Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the “Court Disposition Document” which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel

Thanks for clarification. I still disagree with you. Media outlets do measure the intensity of the issue but not by amount of SPAM they receive in e-mails. From my personal experince in talking to a journalist, if you send them an e-mail regarding the issue they have published they will definitely defend their point or refute yours and may even look at the issue from your point of view but in all cases they will reply. Now if you want to bring an issue to their attention all you need is take their article and simply put your perspective on it. It will have a far greater impact if it comes as a collective voice of an Organisation such as IV. That's why I originally questioned our approach of spaming them by sending 1000's of e-mail with the same issue. It doesn't bring much to the table. Right ? That's precisely the reason why all organisations have a media relations person who represents the collective view of the entire organization and manage the press releases and all contacts with media.
Tell me about getting a response from reporters. It all depends on their whims and fancies. If they want to write, they are after you. If they dont want to they evade your emails. You have already considered our emails SPAM :) Thats what it would be considered if a bunch of people send the exact same email body. If we do send different message, it might still occur to them or a click to these forums will make them feel that we are trying to get more media exposure. I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....
But if 15 month rule of FP is correct then very few will get approved as very few have received 2nd FP notice....so I am not sure what is good or bad...we need to know if the folks who had got FP notice had recently renewed their EADs or not.
I am current next month but I rate my odds as 2/98 meaning 2% chance of getting clear.....taking into account RD/ND/transfer/FP all vagaries into account....even Indian monsoon is more predictable.

My spouse is in a situation where she has spent more than 6 years time on H4 furthering her education/skills and now she cannot apply for a H1. I had read sometime back on murthy.com that USCIS was considering decoupling of H1/H4 time. That should soften the blow of retrogression to some of us.

Who said the position must be in zone V only to qualify for EB2?
For the position to be qualified for EB2 it must require MS. For position requirements to be considered "normal", they must fit into the respective zone in terms of SVP level. As I learned from my bitter experience, though offficially for a PERM to be approved the requirements don't have to be "normal" (if they are not, you just need to supply the "business neccessity" letter), it looks like the current PERM's software just doesn't have such possibility "in mind" and automatically denies the application if the total education plus experience requirements exceed the SVP level for the zone corresponding to the position. You will get a denial notice which will blatantly claim something like "By answering YES to question H-12 you have attested that the requirements are normal, but the total SVP level exceeds the normal level for this position..." even if you have answered NO to that damn question! Therefore I don't recommend to exceed "normal" SVP level for the corresponding position code.
However, if a suitable code falls under zone IV, nobody (except for emplyer himself maybe) can prevent the employer to require, say, MS plus 2 yrs of experience. And it is within "normal" SVP level for zone IV, and it does qualify for EB2 (because it requires MS).

Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.
Malibuguy007 , you seem to me a guy who could save 2-3000 dollars per month and think you are in heaven(Typical GULTI mentality) . These are the points on basis of which i called life of H1 hell
1. Your spouse can't work . Think about their self esteem and self respect they are loosing.
2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.
Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. Try to come out of Sambhar-Rice world(thats the way you save money here and call US heaven). Live with pride ,ok . Fight for being treated like H1 ( HIGHLY SKILLED PROFESSIONAL) not slaves.
