I think If any Univercity needs total X credits to finish US MS then that univercity counts How many credits (Y) one has earned from his past education. So X-Y gives how many more need to earned to finish MS.

Pal, don't try to be selfish and narrow minded here. Step into PBEC victim shoes and then we shall see what language you speak.
Opportunity to speak in front of congress won't come everyday. So we should highlight all the problems faced by us during the employment based immigration process -- whether it is rotting in the PBEC mess for labor certification for 3-5 years or for visa numbers. They all should be brought forward.
The deadlines don't mean any thing but the results in hand do. If it were resources issue, then DBEC would also have been also stuck somewhere with 2001-02 cases but no.. they are processing 2004-05 cases. There is something seriously wrong with PBEC and needs to be fixed.

I hope both Political parties keep aside big AMNESTY issue on the side for now and then work on the common ground like the DREAM act and the EB/FB legal immigration backlogs and reforms.

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? My PD-Oct 2001..Eb3..My wife RIR-almost making it thru I140when all hell broke loose in our lives...my wife was pregnant and because of stupid gynaecologist..she ended up in hospital with complicated premature preganancy..guess what..as if it was not bad enough..her company got acquired just when she was admitted in hospital...imagine wondering about health insurance when she was kept to bed rest with no mobility allowed..we filed for insurance by mistake..which said that 20% in patient.....we were so shaken that even human resource did not advise us..guess what..baby was born..and it was surmised that baby will have long stay in hosiptal...2-3 months(eventually it was 4 months!)..somwhere around the first month..I realized that her insurance..will rip me off..I called right at the end of the first month..and tried several times to put my wife and baby on my insurance so that i don't end up paying 20%..it was lot of efforts until I found some desi in Blue cross insurance who put the whole family from the first initial month..when normally people get the policy for the following month at that time.
one down --and then another came..my wife was called to her office from hospital saying that..since there was lot of work in her office..she could come for some days..guess what..she went back..thinking..she could finish work and then take extended leave....guess what..she was laid off..and with baby in hospital..and lay off..plus a rush to change her status to H4 visa..imagine the workload.....finally got her status changed..to h4 visa..with GC and labor in trash...
I was so disgusted..that I started writing to Governor Shwarzenegger' office..who put me with Senator Diane Fienstein..and of course labor secretory Chao..after all the correspondings..all I got was my D number listed from Dallas..their sympathies...ALL I WROTE to them..Hey I want to change jobs because in those days I was commuting between LA to San Diego..where my baby was hospitalized...I wanted to be with my baby..and not work..but it was not possible..if I did..then I could get out of status...I even wrote to Department of Homeland security...and got no reply...they don't care..I ahve to be illegal to get sympathies..I guess!
Situation was bad..finally baby was out of hospital and I weathered all with help of Almighty...and now I am so disgusted with system..that I am moving to vancouver...
But I have another pleasant surprise..my boss wants me to work from vancouver and visit office once in a month...I don't know...whether it is possible...stay in vancouver and visit LA for 2 weeks and then go back and still maintain H1 status..
what do you say..after all the stress!

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.
Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.
1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.
Does that mean I could get my GC this year.

In the state of Mass delivery is covered by the State provided you show you don't have insurance. Millions of single moms are delivering and many are teenagers and many are w/o any insurance. Delivery is considered an emergency and you will be covered. Keep your spirits up and bear the storm.....it always gets darkest before you see light again.

You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

However I think you better of waiting 90 days from the receipt date and then requesting EAD on infopass. Lawsuit is not a speedy process, the government has 60 days to respond to your complaint and that's not the end of it.

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

One irrelevant question: Why did you wait till Aug 15th, 2007 to file your 485 when your date was current in June and you could file in June 2007?
Just noticed your question - I was actually one of those stuck in the notorious BEC. As luck would have it, my Labor cert which had been stuck in local office processing first and finally made it to the second stage of labor was stuck there as well for months until it seemed like they finally were processing applications that had been received at the same time as mine. Then it happened - all labor processing centers were scrapped and everything was shipped in boxes to the blackhole called BEC. Little did I know then the upfront delay of months would be insignificant compared to the delay of almost 4 years at the BEC. In fact, my labor cert hadn't been processed by BEC even when the Jun 07 window opened up. As luck would have it though, in the month when everything was rolled back, my labor was finally cleared (thank god for small mercies!) and I was able to apply for both I-140 and I-485 when the window opened back up temporarily between July 30th and Aug 17th. Of course, I am still last in the line since USCIS processes based on application received data and not priority date! However, as I mentioned earlier, I am thankful to all of the efforts of IV that led to the window opening back up, which actually enabled me to file my I-485 and eventually receive an EAD (if not, would have still bee completely dependant on H-1, 11th year, now)

That simply cannot happen because then IV as a whole would be acting like a headless chicken. Everyone now a days seems to be starting a drive, throwing tantrums at fellow IVians etc. This has to stop as per most of passive members, it means directionlessness.
I've a suggestion. Let's ask our members, those who want to be the core. Let's restrict the core group membership to 20-25. If we get more responses, we can poll for the most favorite candidates on the forum. Similarly we can ask all of our members for the drives they want to support and poll for the drives. The most favorite five drives then become IV's drives. Most people will not work unless they are given clear instructions. The reason FOIA drive became successful was because it was coordinated well, gave a clear direction to the members and had a clear goal. That is why we raised more money than required for that drive. We need similar type of purposeful drives which will keep all of us motivated. The forum members may vote out a core team member, if they are dissatisfied, I mean we can employ all types of checks and balances for an efficient core team and an efficient drive system.
A ship can have thousands of oarsmen but it needs an able captain to take it to the shore. If you ask me, I'll vote for you as the captain. :)

But let's face reality for a moment - as several senior members routinely point out, inspite of our organization having several thousand "highly paid" members, the "donor" base is very limited. As Zen says in a truly Zen manner "we are where we are"...and we have to figure out where to go from here. Unquestionably, I am really thankful to our highly dedicated Core team for sacrificing their personal time and making all of the efforts that have led to substantial progress over the last few years for the immigration community. However,, that with a new government in place, we now have a truly unique window of opportunity to make some progress and the question before us is how do we maximize our potential to take advantage of this? The real beauty of my proposal is that we could leverage the enormous dedication of the core team and multiply it several fold, if we could build a strong donor base that provides us the funding required to engage effective lobbyists. Needless to say the more the funding, the stronger can be our lobbying.

It is definitely not a good idea to broadcast confidential information on strategies/plans. However, what you are referring to is the merchanics of the process of sharing updates- there are several ways in which we could implement the update process so that information is only shared to a predefined "pool" and that "donors" are first vetted before being brought into the "pool", so to speak. The way IV has currently implemented this process, of course, is through the local chapters. However, their current process is subject to lack of consistency (depending very heavily on the availability of the local chapter coordinators) and more importantly, does not take advantage of the tool that really enables us to all come together i.e. the internet. It is a paradox that an organization founded on the net and is still subjecting itself to the constraints of "physical communication" via the local chapters. I thought they were taking a step in right direction with the creation of the "Donor Forum", however, for some reason, we still seem stuck in the previous mode of operation. We can find a middle ground here that would not compromise confidentiality or our goals - one alternative (certainly not the only one I am sure) is quite simply, email updates compiled by one person (for consistency and uniform direction) that go out a distribution group, where the "donors" on the distribution list, have been vetted by the local chapter coordinators. I know this takes work, but if the Core is looking for a person to pull together a Conference Call to compile this update and send it out, I would be glad to volunteer my services.
Still I've some open issues. If you look at the poll, there isnt a single person who voted NO. We should expect to see a healthy mix of Yes,No and Dont Care. But the way the poll has been put and partly the wording, partly the current IV environment, people are sceptical of putting their real thoughts publicly. This excercise is futile if you have minimal 'NO's --- hope you are getting my point here. The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.
You are correct dilbert_cal - not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). Instead, my focus is on coalescing a group around those who voted "Yes" since they, like me, agree that they would contribute more if they received more regular updates of what is going on. Our organization just needs a little more "organization" (pun, intended :p) to make it more effective! Again, just reality but that is also the usual natural evolution of most organizations that start out as pure grassroots organizations.
I really do believe there are substantial number of folks out there who can be engaged more effectively in this process and I invite the Core Leadership team to put more thought in figuring out how to achieve this - I hope you take my suggestion constructively!

Great point praveenuppaluri. But let's face reality for a moment - as several senior members routinely point out, inspite of our organization having several thousand "highly paid" members, the "donor" base is very limited. As Zen says in a truly Zen manner "we are where we are"...and we have to figure out where to go from here. Unquestionably, I am really thankful to our highly dedicated Core team for sacrificing their personal time and making all of the efforts that have led to substantial progress over the last few years for the immigration community. However,, that with a new government in place, we now have a truly unique window of opportunity to make some progress and the question before us is how do we maximize our potential to take advantage of this? The real beauty of my proposal is that we could leverage the enormous dedication of the core team and multiply it several fold, if we could build a strong donor base that provides us the funding required to engage effective lobbyists. Needless to say the more the funding, the stronger can be our lobbying.

I spoke to a IO from Nebraska center ,they said my data is not in the system.She said no memo has been issued how to process the July 2nd cases,but they will process all the other cases according to VB 107.when i asked more she said she cannot give me any more information i asked her should i resubmit , she did not comment on that i was totally surprised when i asked her when the cheque will be cashed she said october, I again asked her and told her it is not for H1 b it is for I 485 again she said october.Did you any of you guys call the USCIS ??
There is no point in calling them and asking question. Each person gives different answers and they don't know what the heck they are talking about. I think it would be best if we waited 3/4 weeks more and see if we can get receipt number.
It's so bad that we have to work so hard just to get receipt number for our case. I don't know what will happen to our EAD and AP applications. Nice job USCIS!

Apparently someone flagged me.. thats fine.. if people here cannot have a proper discussion without having to flag each other I dont see any point in calling ourselves "smart" "highly skilled".. looks like we need to grow up first. Personally, I dont care about these green/red blocks. I have the right to express my opinion whether someone likes it or not. If someone does not have "words" to argue back thats their problem..
