I saw some postings saying that USCIS can assume the name check is done and is OK if FBI does not get back in 6 months and thats how they managed to approve all those cases in June, is this correct?

How long does it take if I get my GC now (as a bachelor) and then later on apply GC for my wife? I heard its around 4-5 years again?
So, would it be a better decision to wait and not apply for 485 (I have my 140 approved as of Dec 06) now until I get married to be able to apply it together with my wife?

I had a quick question to ask. My, current H-1 visa is expiring on July 30, 2008. Also, my current I-94 and I-797 is expirin on the same date. I am eleigible to apply for extension 6 months in advance, starting Jan. 30, 2008. However, my question is if I apply for my H-1 visa extension now (say Feb. 28, 2008) and the extension comes by April 30, 2008; will that invalidate my H-1 visa stamped till July 30, 2008.
Please refer me to any official memos if available. Thanks in advance.

It seems like any change in the immigration system is only going to land us in a worst position than we are in....
And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.
Any noise we make seems to be making our opponents solidify and press us even harder.
I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

The Mexico F2A and Employment Third preference cut-off dates are �unavailable� for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation. Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.
This is really bad news indeed. USCIS is screwing us up big time. How can they see a demand for the numbers when there is no one applying for the past 3 months?

I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.
1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.
2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.
And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

One step closer.
With last year crisscrossing, EB2 India most apps are cleared upto september 2004. We should not have too many in 2004 except substitution cases.
Hope it will step into 2005 in next 4 months....
Atleast 5 in my office and 5 in friend circle :-)

I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

Thanks for your time and effort. But I believe your time could be utilized for other better causes than monitoring the comments made by the users by using the anonymous green/red dot system.
This internet forum is already anonymous for all the posts being made. Thjere is no way someone can tie a userid to an individual. Then why a separate dotting system that ends up eating your time when someone complains?
Someone's red dot feedback is only his/her opinion of the post; the same post could result in someone else's approval via a green dot.
Just let that feedback hang out there in the open along with the reviewer's ID.
Hopefully, by keeping it in the open, it will also make one to be more responsible in their choice of language while providing feedback.
This may not be a simple change of a switch/flag. But please consider it for the future enhancements of the site.
