In my view, it is too good to be true. But we have no way to challenge the numbers either. But it is 50% of the entire EB pending cases. Is this document authentic?? I don't see the logo on the letterhead??

not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). How can people write this kind of information. Even I have come through and Indian company and I used to pay all taxes here which includes, Federal, Social, State etc.,
This should end. People here should know that we are paying all taxes. And we are paying Social Security tax as well. Because of retrogression we don't yet know if we would get our green card. We still pay for it and we don't take a dime of it if we have to go back to India.
We are helping the elders to have regular pay and this is what we hear? If there is a way as our friend said we should confront this legally.

here are my 2 cents..
its nice to talk endlessly about what went wrong and bitch about it till the morning. one thing we all need to realise is this : we are going to have failures. period. just like we have had failures in the past. this is not going to be easy where you win every single legislation. 10% hit rate is success enough given the opposition and difficulties we face. so now, given that our batting average is going to be low, the question is this : everytime we have a failure, if people are going to sit on their butt, smoking their pipe dreams and doing monday morning quarterbacking about what part was wrong, then shouldn't they also volunteer to their local IV section to make it better? lets face it, if you really think something can be done better, then volunteer to the local IV branch and do it. everybody can benefit. but if all you are going to be doing is sitting here and posting negative messages, then you hurt everybody, starting with you. the opposition is much better organized, has more money and has great influences on the political inside. if you are not providing any constructive or organizational help, causing people to be distracted and causing IV core to lose their focus, and if you are not willing to volunteer to make it better, then in my opinion its best to step aside, be quiet and let the people in charge do it. again, if you are not helping, then you hurt everybody starting with you.
in this case, like paskal mentioned, if you think the phone calls were not important, then you haven't seen the victory message from numbersusa where they talked about the deluge of phone calls that were made by their supporters and how crucial it was in throwing out the visa recapture amendment. if anything, perhaps we could have gotten better organized with the calls. But I suspect things also moved much faster than anyone anticipated, including IV core.
lets focus our energies and support IV core and ourselves.

well, I have to keep my hopes up. Since I HAVE to wait to get H4 extension before I can apply for H1 transfer, I'd like to see them last long enough so that I can get an H1 IN time, this year.
It can be so disappointing to get the job but miss the quota for 2 consecutive years :mad: :mad: :mad: and then 2 years I was ineligible for H1 because of the 6 yr limit. :( :mad:
Anyway, every dog has its day and I am hoping this is the year when I get my H1. :D

No one has unlimited capacity to get things achieved. So in that sense, H4 issues really cannot be on the list. And as far as "nothing is happening, let's get temporary relief and let's not fight for more numbers" idea is concerned, we are already doing that by trying to get 485 filing provision done in next few days as a temporary relief. Now tell me, how is that not tied to H4s. EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.
Logic - Do not get disheartened!!!!! IV will thrive.. Quality in membership is better than quantity.

Fraud is not correct word, it is because of lack of policies or loop holes in the current Immigration System. This can be found in any system, any country, any people. So, there is no need to talk on that. It is better to put our EB related retrogression problems to Congress and no use in discussing these. Otherwise If you start discussing on fraud, every work done by everybody is going to have some kind of fraud. It is to survive and so people do whatever it is, with in the limits of law.
All people who are being labelled as socalled "Americans" came here like immigrats and theft the land from Native indians. So, everybody is doing wrong. That's part of time. Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual �per-country� limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.

The VB when it defines the categories, also defines EB2 as 27.6% of 140K and what ever is left over from EB1. EB1 is current for some time now and EB1 also circularly gets unused numbers from EB-4 and 5 which account for around 20K. If you heard what the restrictionist lawmakers have said about what to do with illegal�s, this retrogression makes sense. The restrictionists want to make life miserable for illegal�s by making it difficult for them to get jobs, this way the illegal�s would go back on there own.
They are trying to do the same thing with us legal�s (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.
You got it right or what!!! That sounds like the modern definition of slavery and seems to be what is happening in US despite all the claims of abolishment of slavery. They just have refined it to a point where it is subtle and not so blatant.
