Dear Friends,
Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
a. Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
b. Requirement : 4 years Engineering + 5 years minimum experience
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

I heard that it needs to be at least 21 months to be able to win the law sue...and suing them might not work anymore when my pending time is qualified.
If someone else with similar names/same birthdays commited a crime, why do we need to suffer as a possibly "HIT"?
If I were to wait for 4 years for Name Check, I rather be the person commiting the crime so they can reject my I485 instantly.

They will allow the applicants for N number of years ( it is not as a favor to the applicant but as favor to the US businesses that employ them ) to work and roam around and won't give the benefit in the name of namecheck clearance. The term blockheads were invented for these.

A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.
So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?

When I am trying to reqruit someone from dice, I see resumes that are heavily bloated to an extent. I see similar resumes with names changed and some words changed both from same city, so maybe they are from same consulting company, i have to dig through in detail to figure out a good resume and finally the chances are that I may have gone through a bloated resume are high.
One suggestion that is in above post is good, INS can releease skills associated with filing h1b petition and match with skills on resume.

The only thing I can think of is that everybody is buying for themselves not as an investment.
Look at the previous post. Its a myth that NRIs are buying up all these high end properties.
Indian real estate market is fueled by the black money india. They are using NRIs as a facade. Investing in realestate legitimizes that money. Now they don't care how much rent they are getting. It makes no business sense at all. You and me cannot comepete with them.

What makes you think you qualify for EB1? Is it because you were planning to apply in OR category? or because you wanted to apply in EA category?
FYI, a fresh PhD has very little chance to make it in EA category, and OR is applicable only for a researcher position.
It's nice to create a big fuss about your qualifications and how you have been hurt, but at the end of the day, these were choices YOU made (i.e. taking up full-time PhD instead of going to work immediately after school). Also, as someone else said on one of these never ending threads, there is nothing that prevented your future employer applying for GC for a future job for you as soon as you finish PhD :-)
So, again, if you are so qualified, and happy to live the consequences of your decision, where is the PLIGHT?

All of this nonsense .."i pray someone does something for EB3" is going to get no one anywhere !! Fight for comprehensive immigration reform or HR 5882 recapture BUT for god's sake Do not blame the EB2 - India people who have played by the rules and are in a favorable position today relative to EB3 !!

the local service center lady said - Assigned to an officer on 9/11 - now HOW MUCH OF A WAIT AFTER ASSIGNED TO AN OFFICER? recent approvals folks - can you shed some light?
you should get it soon. Call the service center where your case is to check further as online status is not a good indicator. In my case per TSC i was approved on 9/4 but my online status did not change until 9/11.

Nothing ever is super-fast. Certainly not the green card. You had your share of waiting. Its just that you suddenly see light at the end of tunnel and before you realize you are out of it. So it feels like a dream.
There have been folks who have got their greens in two years flat. Not because they were the smartest workers around. That is lightening fast.

Again, I would like to reiterate that I DO NOT consider an EB-3 candidate inferior just because he/she belongs to a catergory with a lower priority.
But, if you agreed to file in that category then you probably made a compromise and it is not wrong. Everyone is a victim of circumstances at one point or the other in their lives.

Speakers urged the audience, many of whom are undocumented immigrants, to call their elected officials in support of the Kennedy-McCain immigration reform bill. Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. New York �is a special place because of immigration and the worst we could do is close the door,� he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. You are saying new OBAMA govt. in many of your postings. Are you his election agent?. This forum is not for any party affiliations. Election is yet to start. Democratic party is not officially announced their candidate. All powerful President Bush is tried hard to help immigrants. Then how come a weak person who is still fighting for a ticket can take left and right congress and senete veterans.!!!!!!

The new OBAMA government's agenda is to take the immigration reform during his first year tenure in the ffice. Once the immigration reform took place, I am pretty sure there would be significat changes in employment based category, which drastically decrease the backlogs in all EB categories.
In addtion to that "legals are first than illegals"- OBAMA. This itself is enough for clearing off all the backlogs.
