Your view is right myfriend. No one cant be in your shoes but it cant be channeled at L1's. ppl here feel the heat of outsourcing through H1/L1 as thats the route taken. But if there is limited oursourcing everyone is happy. We are missing that and technically that cant happen due to trade issues... as i said If not H1 then L1 else B2....... On B2 one is NOT supposed to work they still abuse.. .

you will know when you face layoffs and unfairly they target you.

That is right. There are people knowingly get into dirty deals with employers like
    (1) Faking experience
    (2) Working out per diems in percentages
    (3) Changing job titles to suit their needs
    (4) Most important - employee tries to do what he/she can to keep employer happy as the green card petition is filed - I have seen this - people I know do this - they lick the boots of their employer - get coworkers fired so that their jobs are secure - get personal in alomost everything with employer so that they feel secure and job satisfied - These are the people who come out anonymously and talk bad bad things about their employer because they know they are into a screwed up relationship - no pay hikes, employer cheating on perdiems - employer knows employee is ass kissing and talks sweet but exploits - employee knows that things are not going to be the same for a prollonged period - puts a false mask and blames organizations like IV for not doing anything - these are the folks who encourage employers to do what they want to do.

And the day these employees get their green cards, they will open they companies and will do the same thing to the new immigrants; and the circus will go on.

Not sounding too pessimistic - but I do not see any option in the 7th year, than making my employer richer by the day.
Have let go two excellent opportunities slip by in the last 6 months from highly reputed Consulting companies while continuing to work for my desi body shopper.
Already have a US MS - and given the question on ROI, decided against an MBA.
Hang in there.. and hope for SKIL to pass.

I am surprised that Canadian companies do not recog US experience. WHY???

I'm like everyone else - 7th year on H1-B. Sick of thinking about my career. I filed my labor in Aug 2002 EB-3 and so I'm also a retro victim. I'm convinced that GC will take another 5 years to come to my date.

    There are few options:

    1. Apply for Canandian PR and then if you are lucky you may get a good job in Canada in IT or else you will end up working in Wal*Mart or some grocery store cursing why you came here. Canadian Companies wants Canadian experience. US experience is not enough! :(

    2. Just enjoy without doing anything and hope that your GC would come before you die. :D

    3. Do some Masters degree. I'm currently erolled in a masters program and would somehow try to finish it. It would keep me focussed and create positive energies in me. Otherwise due to utter frustration, I'm not able to concentrate and work. If you are wise enough you would understand that there is no place for you here in US and you would push off immediately. :)

Understood. Now you want all H1 L1 B1 everything to be stopped. So lets vote only for EAD/AP/GC till you get your GC. After that US should stop GC also, right? (but ofcourse, naturalization still should remain open for a few more years).

If one person can work for your job at $8/hr, and you are charging $100/hr, market would adjust itself to $8/hr (for a moment forget about who does this $8/hr, it can be a high-school kid, or anybody). The only reason why somebody blames that $8/hr kid for loosing his job is because he "thinks" he is "superior" to that kid. There are many situations where companies decide to retain "fresh college grads" and layoff "senior experienced" persons, to save money.

Don't take me wrong, but I also think the L1 is mis-used a bit. But I personally think the mis-usage comes from other factors (like H1 unavailability, employer prefer L1 because employee cannot change to another employer in L1, other H1 restrictions) etc..

I would not say there is a lot of misuse. In any law there will be some level of misuse / abuse. Because of current economic situation, this is just hyped.

More, I think the angle to look at H1 / L1 misuse is wrong. If any misuse / abuse is happening, that is because of improper address to labor situation. If government believed that there is a shortage in labor market, they should allow a person to come on his own visa that is independant of employer. Let that person fill the labor shortage gap. Rather they made everything employer dependant, gave employers full change to misuse / abuse the H1 and L1 category and the real solution to the issue - work force is paying heavy price of idiotic visa policy.

It seems like different people have different experiences with different kinds of insurances. So it is almost clear that these insurance can act good or bad case by case basis depending upon their policies.

    Hi All,

I want to share my exp. regarding visitor insurance for my parents.
we took ICICILombard in india itself. My father has to see the doctor for
a small procedure done on this toe. He developed because of injury as he is diabetic.

And after reading so many negative reviews i was afraid whether i will get my 1200$ claim accepted or not. As i thought diabetes is a pre-existing condition.
And we also mentioned it in the insurance policy when we took.

But surprisingly we got the claim approved by ICICI Lombard last week and we got all the money (minus 100$ deductible).

So it's better to have some kind of insurance (to be on safe side) if you think the patriot and KV Rao are expensive.

    Good luck.

    Kris

    Here we go again.
Jees, stop posting this over and over man.

Why not, we need all of you to be active state chapter members. If you are then this is not for you, but if you haven't already, then join and make a difference. We can have interesting discussions and there is absolutely no problem with it, but we also want members to further IV goals. As the model followed is an all volunteer model, all of us know, volunteering does not come as given for everyone. Some need to be inspired, so need to be pushed, if we did not have people who did this, IV would not be existent. Try to understand why people ask everyone to join state chapters. I will stop lecturing now, but yes, threads need to be hijacked to get the point across. Without grass roots organization we will not make any progress and will defeat the whole purpose of having an organization being build from the ground up.
Thanks and appreciate your understanding. We want everyone to be involved, we must be able to use all means to get the point across which could mean making a point in different threads too.

Unfortunately, country of birth for PD determination is one thing that cannot change. It is ridiculous that a country like the US that promotes itself as a meritocracy and a country of second chances ties the fate of EB applicants to such an immutable parameter.
I understand that your priority date is based on country of birth. I have read that you can use your spouse's country of birth. What if you have nationality in a country for over 20yrs but born in India. My parents emigrated to Europe when I was three months old, and I was naturalised there. The spouse rule doesn't apply to me because my wife is born in India too. Is there a rule anywhere that makes you eligibile to file under a particular quota if you had nationality in that country for a VERY long time? I was told no, so throwing this out to the group for advice. No hopes that I will hear otherwise.

    Thanks to all.

Paid membership will not benefit the cause of IV at all. IV is a volunteer organization and paid membership will not do any good. Better approach is to raise awareness and tread a fine balance in asking for contributions.

Look at NPR. (National Public Radio) It is a public radio service and it's expenses are mostly footed by volunteer members like those who contribute for IV today. I think the key is raising the awareness and realizing that results take time.

    Folks -

Two pronged approach to fix Lou's bigotry:

    1. Mail an empty trashbag to Lou Dobbs, to reach by July 31
Let us each mail an empty trashbag with a covering note highlighting how biased and untrue his 'reporting' is.

    Mail to:
Trashbags for Lou Dobbs Senseless Bigotry
    1 CNN Ctr
    NW Atlanta,
    GA 30303

    (or)
Trashbags for Lou Dobbs Senseless Bigotry
One CNN Center, Box 105366, Atlanta GA 30303

Imagine, what THOUSANDS OF TRASH BAGS would do in terms of media coverage and buzz!

    Trashbag = $0.05
    Mailing = $0.39
Opportunity to remedy the bigotry = PRICELESS

    2. File online complaints at following direct links!

    Report Errors on CNN TV
Send an online report NOW (http://www.cnn.com/feedback/forms/form6a.html?2)

Send a story idea (on high skill legal immigration)
    Link here (http://www.cnn.com/feedback/forms/form11b.html?2)

Lou Dobbs Tonight - Comment on the show
    Link here (http://www.cnn.com/feedback/forms/form5.html?76)
    "]http://www.cnn.com/feedback/forms/form5.html?76 (http://www.cnn.com/feedback/forms/form5.html?76)

These will be more effective than trying to boycott Toyota, or other advertisers. Let us get direct and rebuke CNN for their shameless attacks on high skilled hardworking immigrants who continue the tradition of working towards the Great American Dream.

    Cheers!

    Sanju,

I'm one of the past victims of your abusive language. ( remember " You are truly a Pakistani terrorist")

Honestly, i was very surprised to see that from you. Your past posts are an example of the kind of insight you bring in.

Hope you can speed dial that other side!

    Guys!

Sincere request to everyone. Please stop this discussion right away. Please for your own and your family sake, concentrate on FOIA. If you have extra energy, please help NeedHelp! to prepare what data and in what format we need. But don't spit negative energy here.

After a long time I am seeing some positive movements on IV, please don't kill it.

I completely disagree with your message here. You dont even know what the personal reason for not participating in a state chapter is. I, for one, am unable to join a state chapter, because , the nearest chapter is 400 miles and 2 states away. What good would it do to me to join something that I can never be part of. I wanted to start a state chapter here in my place, but I couldnt find any useful resources on how to do it. May be eb3_nepa has some reasons like it.

Like you said, IV is not a top-down organization, which means everyone is responsible for everyone. I dont see anything wrong with eb3_nepa's questions. He wanted to know what is going on. I am sure there are lots of people around here who has the same questions.

The Admin Fixes letter campaign was a good initiative. But, the target date got moved twice, and now I dont even know when the end date is.

May be IV should be a top-down organization. Any organization as big as IV would probably be better served with a Top Team. That team could probably elected by the community. I am confident, that most of our members wouldnt even mind spending a few extra bucks to pay a honarary amount to this team for their efforts and time. Then there will be more structure and accountability and action going on around here.

I came to know about IV pretty late. When I did learn about IV and joined IV, I was a very enthusiastic participant. Of late, I do believe IV is fading away. I dont see so many activities going on around here. Like eb3_nepa and few others said, IV is right now becoming just another Immigration portal. It is starting to lose its identity.

After doing all the hard work to gather a mass or like minded people, it will be shameful, if IV drifts away from its stated aim. So, may be it is time for every member, including core members like you to refect upon things and come up with ways to make this organization more transparent and more accessible for people like me.

Like Waldenpond said, it is probably not wise to list all the items going on in the portal. The work around to that would be, we can add another membership type which is more restrictive. This membership group will have only members whose identities have been verified. Once this group is created, IV can post all the happenings accessible to them. This will help people like me who are unable to be part of any state chapter to know what is happening at IV. Keep our sprits high.

    Thank you

When you join a state chapter or a group in your area, it is not necessary to conduct face-to-face meetings everyday/every week, although in person meetings wouldn't hurt. The idea is to create a channel to dissipate information through channels other than WWW. Believe it or not, there are lot many folks from anti-groups who lurk around just to keep an eye on us. Participating or becoming part of the group near to you and encourage others to do the same will also help to build/strength a group of like minded folks in the area who could then team-up to meet with local lawmakers from your area/state. We are a grass roots organization and we need to have a stronger grassroots in order to continue to be more effective. As I said earlier, this channel also is very useful to dissipate information which cannot be shared on world wide web.

Now a days when everybody has presidential election on their mind, immigration issue is not on the list of things to do for most lawmakers. As such, it takes time for the updates and the there are updates that cannot be disclosed on www. We continue to work on our issues in manner we have always worked in the past. And in the absence of Congress not taking up our immigration issues, it some how becomes our fault even though it is ok if some folks would show up from time to time and suggest that they have reasons not to join a google or a yahoo group. And all of a sudden the problem is with organization and the manner in which we work and then there is an urgent to create a “process”. Although you seem to be suggesting that you want all the ducks in the row and world peace issues sorted out before you will start accepting updates in exactly the manner in which you like to receive them. Is that correct? How about the idea of getting actively involved in your area and create an active chapter, which was your idea to begin with, and one I would agree is an excellent idea.

It is of'course a valid question - “what is going on”. Also it is a very general statement and one which can have a very long answer and one which can be answered in few words. If you become part of a group in your area, you will know what is going on. Please understand that a significant number of members are putting lot of effort, if others are not able to participate actively, is it not fair to ask others to help in organizing in groups in the local area and be regular communication so that action items could be handled effectively?

I am trying to get the original question info from him. Probably he will read the thread and answer it.

"EB Applications pending from India" is very vague, and most probably is not what we are looking for.

USCIS has indicated earlier that they don't know chargeability country until application is ready for approval, which may be true although we didn't want to believe this. Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.

For proper handling of cases for retrogressed countries, USCIS/DOS really have no workable method in place.
