If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?
Yes, EAD and AP are issued and renewed as long as I-485 application is pending. It does NOT matter if the PD is retrogressed.

I hope you are wrong about this. I do not see anything on the Approved AP that it should has been used for "humanitarian" purpose. It just mentions that the intention of AP is to allow the AOS applicant to return after temporary travel outside US. Correct me if I'm wrong.
You are wrong. Read the document completely. it does say humanitarian or public benefit. having said that there are abt half-million people in US who are in AP today.. so i dont think the immigration officers wont harass us so much.. :)

Efiled @ TSC on may 29th.
FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.
GO IV GO.

No votes for 2003 and earlier. If this sample reflects reality, thats good news, dates should not retrogress too far back. Quite a few 2004 cases, but with the dates for them going current next month, hopefully many of these people get approved, and the queue moves ahead...

It wont happen again. after encashing I485 checks USICS will start I140 PP again to keep cashing money. once I140 backlog will be done then they will earn from EAD renewals.

If not expunged, it will FOR SURE pop up immediately they punch your name in. You certainly can not lie there. You will be deported. If expunged, you still have chance BUT NOT to lie..If the form ask " If you have ever been arrested" say yes and as others suggested have all your documents ready from court but make sure you have all originals and notarized documents if required for all court orders pertaing to your case.

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
However, this shouldnot encourage you to be dishonest at POE's or visa interview.

My wife is apply for AP renewal. She has her AParole until oct, 2,2008. She is travelling to india this week for three weeks. Can she apply for renewal and travel to india. Is it legal or does it have any replications.
According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.

First of all learn to "conduct" yourself in public before working for the semi conductor industry. What is gulti mentality pls explain? Second of all you chose to come here with the constraints that were imposed on you, did you have the balls to question the immigration officer as to why your wife could not work? If you think this is hell my friend you are in for a rude surprise.
When you want answers for your question there is a method for asking it, pls follow that method and you will get your answers, there are more people willing to help here than you will find anywhere. Ranting about communities will get you no where, now apologize and ask your question, someone will answer.

A quick analysis of election results and its relevance to us:
As of 11:45 PM PST, House has gone to Democrats in a landslide; the Senate is on its way depending on outcome in Montana and Virginia. If Democrats win MT and VA (Jon Tester in MT, Jim Webb in VA), the Democrats would control the Senate too.
What it means for us:
Change of control in the House:
This is of biggest consequence. Since Democrats won the House, every chairman of every committee in the house will be a Democrat. They will decide what goes into each committee, what comes out of the committee, what gets floored on the house floor and when. They set the agenda, they set the timetable. They run everything...including what gets served in the House Cafeteria and who occupies which office and who gets how much budget to run their offices. Republicans in the last few years have followed the mantra of “Majority of the majority” when it came to setting the agenda and timetable of house floor votes. What this did was, bills that would win the majority of 435 votes by combining Democrats plus moderate Republicans never got floored onto the house, since the majority of majority (conservative republicans) were against such CIR and by that token non-receptive to the legal variety of immigration.
To get an idea of the minority in the house read this quote from more than a 100 years ago:
”The job of the minority is to make a quorum and to draw its pay.”
-- Speaker Thomas B. Reed, 1890.
Throughout 2006, the biggest obstacle to high-skills-only bill to be floor on the full house or on the judiciary committee was the Republican controlled judiciary committee headed by Jim Sensenbrenner. He has won his own race(Wisconsin’s 5th) – no surprise there – he would not be heading the house Judiciary committee. Even if Republicans would have controlled the house, it would not have been Sensenbrenner, it was his last term as chair of judiciary committee. Whenever there was a non-CIR bill related to high-skills employment based immigration, like the one sponsored by John Shadegg (SKIL bill of the house) it was referred to House Judiciary committee. Even my papers were filed on 2nd july before revision of VB. My questions:
Since VB is revised, my application would be rejected and sent back to Attorney's office. But when? How much time does it take USICS to send these application back?
What if it goes beyond October bulletin? If by chance (which I doubt), my dates become current then how would I be able to file my papers again, since medical reports are still with USICS, they had not returned it yet?
Any ideas?

Also we cannot deny that Corporations also reason for putting the h1b restrictions. Why Indian consulting companies applying thousands of H1b in one day? I doubt usage of number h1bs are atleast 50% They were also wasting lot of h1bs just by applying and staying in India waiting for Job opportunity materialise but here many companies could not get persons for many projects. Some solution is needed for this issue for proper utilization of H1bs. Corporations could have suggested some solution for this if they are really responsible.
According to lot of estimates 100k new jobs are created and if we include retiring people and rotating people real new requirement will be 150k persons including H1b and L1. H1b numbers(115-180K) in the Senate bill are fine according to Industry estimates if industry is just using for new jobs and vacancies of old jobs without replacing current workers. It is too much restrictive in the bill but someone has to suggest alternative solution for the current problems. If they just remove the restrictions when they open new H1b cap will be reached within few days again corporations lobby for more H1bs.
I'm surprised that everybody in this thread got so scared of the language in a stupid bill and stopped thinking how clever Indians are in finding loopholes. I hate when all the extra-ordinary people think in the same direction. To start with, is it possible that these jokers will pass anything agaist the will of big techs like microsoft, intel, csco, think again? even if they did to make average(stupid) Joe happy, they wil keep loopholes making the law irrelevent. e.g. H1 quota limited but L1 unlimited. businesses more than 50 emps can not have more than 50% H1Bs, what do u think big desi consulting cos are in trouble? they will simply 10 more companies each having 49 people.
Other direction: when i came to US in '99 from SEEPZ, my US salary(in Rupees) was 12 times my indian salary, now it's just 2 times. Indian salaries are increasing 10-20% every year, and Dollar is going down (down 20% in 6 years, 40% including indian inflation), very soon there will be no advantage in coming over here, and you are worrying about future H1s having trouble getting GC?
No matter how stupid and selfish politician look/sound they always think about their contries future, and folks these are US politicians. take it easy and take a walk outside, it's nice out there.

Definitely not at the place where I am working.
The place where I work, people eat burgers in the meetings and we have a very small kitchen in our floor and there is no Cafetaria as such. If I had to put up with the burger smell, I expect my co-worker to put up with my Indian food smell too...

I'd say, we've waited enough(6-12 years). I know we are all chasing the american dream (perhaps it is just a dream), we should just make peace and move back. Thank you congress, america for giving ppl (from so called 3rd world nations) like us the chance to come and serve this great nation.
