I'm sure people here dont have that agility and adaptability to adjust in India and China. Though I heard lots of gora are in Hyderabad and other cities that wont be for long term. And without people from India/China IT can't survive here. Much bigger market (than Internet) will be fighting global warming. These guys won't screw their future by doing all these nonsense laws. Let us "C" what happens.

Hi All,
All this memo states is that USCIS will not automatically expedite the FBI name check simply because a writ of mandamus is filed. This memo signaled a national shift in the way USCIS responds to these types of lawsuits.
The U.S. Attorney's Office will now fight the writ of mandamus lawsuit by filing Motions to Dismiss and Motions for Summary Judgment. While this obviously lengthens the time it takes for a case to proceed, it is still very possible to win and force the government to adjudicate the application.

Yes this is not a typo. This is true. Aman has made more financial sacrifices and time sacrifices than anyone else. Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. The kind of work and effort that is needed to push a single provision is phenomenal and needs lot of capital. The more the better. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. This website is simply a tool for us to communicate to everyone. The big effort is the lobbying work. I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose.
*sigh* I might have just opened myself up to the ones that like to attack....go ahead...

It is very easy to prove that USCIS did injustice to those with EB3 dates prior to 2004 or 2005 if they stick to the rule of FIFO.
If the first criteria is met, everyone with a PD older than the lastest EB3 ( I know some who got approved with EB3 PD Jan2007)approved so far should also be approved. Or USCIS should go and revoke the GC's to newer PD and allocate them to older PD in the EB category ( I don't like this option).
So let us dream and someday it will come true. If we scream soon our throat will go dry.

I posted my comments and my story (with links to couple articles that were published sometime back about my case in a newspaper).
Lets add more stories. As someone already suggested lets concentrate on how our GC can contribute to the economy - buying a house/establishing a company/etc. I also quoted some of the recent studies that showed how immigrant entrepreneurs positively contributed to the economy (couple links from IV).

USCIS service centers are holding adjustment applications filed based on the initial July Visa Bulletin. Some applications received on the first business day were returned, but all applications since then are being held and not returned. One can speculate on the reason, of course. Possibly USCIS is preparing for a loss in litigation. Possibly they are preparing to cave sooner. Let the speculation begin....

The GC system is entirely in our favor. It really does not benefit America in any significant way.
nope, if the alternative to the GC system is outsourcing (as you yourself mentioned) all the profits go to big corporations and our salaries are spent in India. The corporations are notorious for avoiding taxes so teh government gets nothing. By making us stay here longer (on H1 or GC) we end up spending our salaries here, paying taxes, paying social security, paying medicare.
65K H1-Bs earning 70k a year is 4.5 billion dollars. 140K new GC holders each year earning the same comes out to 10 billion dollars. Out of that taxes alone are an easy couple of billion or more dollars. Then take into account the side-effect (we buy cars, we buy appliances, we rent apartments) and the contributions we make to this economy are a lot.
And to say that we are stealing jobs is also inaccurate. There is nothing called stealing-a-job. In general every job is worth how much someone is willing to be paid to do it. If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K. The H1-B visa holder is not stealing a job. The days of knowing HTML tags and commanding a salary of 100K a year (1999-2000) are long gone and now replaced by 'that kind of work gets done in India or Ukraine for 10k a year'. Looking at the resumes we got in response to job ads placed in the last 3 companies I worked for, there are simply not enough qualified americans interested. Thats a fact. So the IT sector needs help from abroad to get the job done. They can either send the work over, or bring the people here. Bringing the people here also benefits the rest of the economy.

A lot was said above but some basic things still need clarification.
I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...
No I want the RIGHT to get my GC as soon as I land here on a H1B. They should give me the GC at the airport itself. I'm not waiting one day even. ;)

An MBA from an accredited AACSB university is a good investment for the long-term. May be US corporations can tactically support this bill because this bill will impact Indian bodyshoppers severly. For past 5 years US companies could not compete with Indian companies as they have more leverage on H1b. Now if Indian companies avoid H1b US companies can get any time they want as they can satisfy most of conditions
Do you guys really think this bill will become a law that too in its current state and the added amendments? I seriously doubt it. If it is then dont you think the corporate business lobby that has fought really hard to increase the h1 b's to 115000 would have just sat mum while the H1 B fees were increased? I think this bill is just getting too absurd to become into law. I dont know but it would be interesting to hear what the businesses have to say with the increase in h1b fees.
May be I am totally wrong but just thought of posting this because I have been reading so many depressing posts from everyone. Have hope and faith. When the going gets tough, the tough gets going. At this point we need to strategise, which I am sure IV is doing it excellently. We may need to make a few compromises but try to make friends with others who are lobbying.
Please dont bombard me. Its just my thought. Please ignore this post if it offends you.

Just a correction SBI charges Rs. 25 for every transaction whether < 1000 or more.
Service charge of Rs.25/- (inclusive of Service Tax @ 12.36%) will be levied on every transaction where foreign currency conversion is carried out w.e.f. 16 May 2008.
As per experience, they will not charge if you transfer money directlty into SBI branch in India and if it is Greater than 1000 USD into other than SBI branch, they will not charge even that 25 rupees service charge... It was my experience till last week....you can check with customer support specailist on this.....
