Define which Indian community?
Gujratis who own motels and shops and will want more family immigration vs H1B
or
Indians who are now citizens. They will want less Indians to reduce competition for their jobs or for their children.
or
Desi consulting owners : less said the better
or
Desi H1b, students EAD etc...
They are a scared lot anyways and only worry about their immigration status and making dollars. Go tell them about IV if you can?
So tell which Indian community you are talking about?
Gangu ???
Didnot understand ur first two points... Are Gujaratis not indian ? Can you be little more specific ?

in year 2007 EB-3 india got 17,000 green cards, still not enough to take care of the high demand. there are just too many people waiting, that's the fact and nobody can do anything about it...except for supporting IV for these three bills...

whats your point?? He could be from anywhere!! How does that matter with his difficult situation??
Am I the only one who thinks like this.. correct me folks.
The guy who initiated this conversation came here nearly more than 3 months back, has just 5 posts but a ton of energy to fight with US employers. Starts a topic, and we are all getting diverted in posting in this thread.
I definitely support complaining against anyone who breaks the lawy, be it employer, or employee.
In this case the guys as he "claims" appears to have come here without employer calling him. And is trying to complain against. Who will be screwed up. The employer can easily say he anticipated, but no project no, so didnt get the guy to US, as its legally allowed not to get.
Again, I STRONGLY feel this thread, and the similar, are all in an effort to divert our attention. Just stop these by not bumping them, with our comments. Let mine be the last.

Since they will be a party to this along with you it is better you talk to them and make sure they assist you properly. Also was your insurance at that time conforming to state minimum requirements if that is the case then you can breathe easy since you had done everything that law asked you to do so hopefully there is no criminal case against you. Worst if court ask's you to pay financially you can declare bankruptcy and minimize the impact. I am sure that does not affect GC. But rather than forum you need a good attorney to talk to. Make sure who ever you select to talk to about this accident case you arrange a meeting between this lawyer and your immigration lawyer so that both are well aware of situation.

Wondering why USA citizens does not learn ERP/CRM applications when there is such high demand in these fields . Any thoughts ? May be they are pure lazy ? May be they think that if they are kind enough to study BS/MS that automatically entitles them to such jobs and they need not to put up any extra mental effort to learn some functional stuff .

For my situation discussed above, I took an infopass appointmnet at Baltimore and they couldn't offer a concrete answer since the case is pending with TSC. They asked me to reply to RFE asking for extension and provide supporting documents. I'm not sure if that would be accepted and results in denial of I-485.
In 2005 for a family based I130 I recd an RFE for birth cert which was not available and somehow could not arrange for the negative certificate in time and asked them for an extension as my papers were to come from from mumbai and it would take more tiime as we had to get the documents from courts in mumbai and ahemdabad.I was sent a denial notice and had to fie a motion to reopen and pay attorney extra money to get the case reopened. So as far as I know they do not issue any time extensions and would decide the case on basis of documents submitted and if these documents are letters asking for more time then I assume they would deny the case as they did for me in 2005.
Good luck.

I am working for a fortune 100 company for last 12 years, rose to a senior level position. It's not easy for me to leave my present job and get the same position, level, responsibility and salary and potential for future growth. Except GC I have everythign else, but sometimes the wait is frustrating.

Please read page 2 of Yates memo (Refer link). The Initial evidence "Annual report", "Tax return", and "Audited financial statement" map to "Employment of the beneficiary", "Net income" and "Net current assets" respectively.

My 140 is approved today. Tax returns can be used to show the net current assets satisfy the ability to pay criteria. May sure you back it up with some good explaination.

There is obviously no insight, memo or communication that USCIS ever provided to us, this is the first time that we even heard from USCIS(That too thru a Senator) on real number. All you can do is make a guess....
Until 2005 we didn't know the word retrogression, so majority of Indians filed under EB-3. So I have distributed 2002, 2003 & 2004 evenly. then gave small EB-3 numbers to 2005/2006
It was in the middle of 2005 was when retrogression actually started or was warned by Lawyesrs(it actually started in oct-nov2005 I don't exactly remember). So people started filling only under EB-2....Since lot of 2004 cases have already been cleared, I put 10K in 2004 and evenly put 20K in 2005/2006...
Great, appreciate your insight. It will greatly help everyone to understand how you reached a conclusion for these numbers. Could you share with us the reason or logic or calculation or study or memo or communitation to support these numbers?
Thank You.

You are right, it is very hard to digest, even for you, who seems to support it. And, if I may add, your example it too "complicated" for me. Try giving easy example for me, I am kind a slow, maybe I should get some "preferential treatment". Yes, that's the word, "preferential".
Country quota is NOT affirmative action, nowhere even close. If you are socio-politically dominated by Indian or Chinese, yes, then it is affirmative action. But if you do not come from a place there Indian and Chinese imperial powers have taken over the country, then how are you socio-politically dominated by Indian or Chinese. And if you are not dominated by Indian or Chinese in the country where you came from, then how could it be "like" affarmative action.
Maybe you yet don't know, but Indian and Chinese EB applications cannot vote and they do not have any representation in the US government. So its not that you are "not properly represented" and Indian and Chinese have all the representation. WE ALL HAVE NO REPRESENTATION. Just so that its clear.
Your next argument is that you are "overwhelmed" by Indian and Chinese so there should be country-limits. Well, I can understand that, we are very overwhelming people. You see 40% of the world population gets 14% green card, we tend to become "overwhelming" for other.
Observation: Each time, I reply to each and every part of your post. But you totally ignore what I write. You did not answer whether you think you are equal? inferior? or superior? That is the question. Hope you answer that.
Quota system treats everybody anything but "equal". And this is not just the question of equality, because I am sure you agree that we are equals. It is the question of PREFERENTIAL TREATMENT. You are in the category getting preferential treatment, so you oppose any change, you "create" arguements that you were "promised" a system when you came, and thus any change to the system, before you get your green card would be WRONG and UNFAIR. So you should continue to get that PREFERENTIAL TREATMENT. And PREFERENTIAL TREATMENT to you is NOT WRONG AND UNFAIR. Right?
BTW, hope you liked the You tube video, Frank is really good. I do not want you to go, so that's why I posted the video. Hope it helped you to stick around. Now don't say you have the right to watch it 5 times and I can watch it only once because I am from India and you are ROW :D
Cheers,
I did answer you question, though not explicitly. I hinted that all of us are equal. And BTW: I am an Indian!! (with India as my chargeability area).
Everybody: no posts about frogs pulling down frogs, alright. This discussion is anything but.
And Thanks for the vid post. I am a sucker for comedy (anything to get out of the tragedy that is GC process).

See what I mean. More than stat-arb, the HFT programs keep looking for pattrens in order flow and front run them. Thats why you have lattice trading and when a fund wants to sell a big block, they dont even go to the exchanges. they pick up the phone and call someone "upstairs"

But is this ok to do?
Is this a legal option for a non profit? If so, I suggest we go for it!
Here is one scheme I have been thinking about:
1. Every week members donate any amount they like over paypal
2. At the end of the week one of them is selected and refunded 2 times his contribution amount
3. To make things interesting and ensure the scheme "helps" and not "hurts" IV: Change the selection process every once in a while e.g. One week you select the user who has donated an "average" amount, but next week you select the "highest" donor, in the 3rd week you select the "5th" name in the donor's list irrespective of his amount, and so on.
e.g.
consider the following players/amounts in a given week:
user1: $20
user2: $100
user3: $10
user4: $45
user5: $25
user6: $50
user7: $25
user8: $5
user9: $10
user10: $100
________
Total: $390
Divide by 10 users: $39
This week's selection process: Select the "average" donor.
Who donated an amount closest to the average? : user4 ($45)
Therefore, refund user4 for $90
What IV received in the process: $390- $90 = $300
The other BIG question is: what incentive do people then have to sign up for monthly contributions, which is clearly the preferred way of contributing as it helps in planning and budgeting? The answer would probably be "bigger" prizes for those who sign up for monthly contributions!
Of course... if only people realize there can be no greater incentive than receiving your Green Card sooner/ being able to apply for AOS any time after LC/PERM stage is cleared.... we would not have to care about all these fancy ideas!
Too bad people can't see what is "2+2" until it is shown as 2*2*2 - 2^2!
